eBay Purchase Where Auspost Stuffed up

Hi everyone,

Wanting some information as I bought an item off eBay ~ $500.

The seller sent it with signature on delivery and everything was going fine until…auspost stuffed up.

In the tracking it says the item was delivered but when I called up to follow up on this, the person on the other line acknowledged that there was actually no signature and would open an investigation which has currently led to nowhere. Auspost has told me to open up a case with the seller with item not delivered, as the seller didn't have insurance, the maximum they can reimburse is $100…but I feel bad in this situation where it's clearly not the seller's fault and I don't want to be $500 out of pocket for an item I have not received.

Any suggestions on what to do in this situation? I could easily initiate a chargeback but that would affect the seller, which again isn't something I want to do but I really do want either the item or my money back.

Update : called auspost, as tracking says delivered but no signature. Someone then proceeded to tell me that 'delievered' on tracking does not mean it's always delivered to the recipient - it just means auspost no longer has it? Wth? Person said they would check with one if the service depots if they have the item which begs the question - what is the point of saying something is delivered if it's actually not?

Might be worthwhile contacting the seller and having a chat about it. If I was in that situation that would be my first avenue and then failing that I would try opening a dispute with PayPal. If you have paid $500 and not received your item it's certainly not your fault.

I would just mark it as item not delivered and let the seller deal with AusPost.

However I would be surprised if AusPost is only liable for $100 in compensation for a $500 item when someone pays for signature on delivery and AusPost fails to get a signature on delivery.

    • I would've thought that too but according to the auspost person, the maximum they pay is 100 if the item was not insured, and that's only if they used signature on delivery so other items would be less if they weren't sent with S.O.D…

      • They can say what they like, it is not entirely up to them (eg. if they were negligent, etc). They are probably just stating what their limitation of liability clause in their contracts says.

Regardless, it is the seller's fight to take up, so him or her worry about it.

Auspost owns the mail article for as long as they've control of it. They may view its value to be $50 or $100 unless the sender has an agreement that the value is more than that. The sender must purchase extra cover up to $5000 if they wish to claim an amount other than $50 or $100. They may also deny a claim if they want.

      • where an article has been lost or damaged

Not sure this happened in this instance? Sounds like it was delivered, but to someone other than the addressee.

  • Unfortunately (for the seller), this is fully between the seller and Auspost. You should make a claim with eBay/Paypal/etc and get your money back. Seller should pursue Auspost.

  • AusPost’s refusal to ever take responsibility is how they can pump $10.8M into the CEO’s pocket each year
