What to Do? 'FOR SALE' Property Sign for Someone Else's Placed in Front of Our Ground Floor Apartment on Our Fence

So there's been a big FOR SALE sign placed in front of our outdoor area blocking out our view that's selling an apartment upstairs. They installed it this morning at like 6 bloody AM and didn't notify us that it'd be happening at any point. Auction is in 24 days.

  • Is it on your property or on common property? If on yours, just remove it. If on common property, talk to the body corp and they can talk to the agent about maybe moving the sign. But you're not really entitled to "the view" or have any rights to it, so if the body corp doesn't want to help you, that's that.

    • had a look at the sub division, pretty sure it's ours I think (altho that makes me a bit concerned about vandalism and who's responsibility it might be to clean it up..)

      • Wait wait - it's on your actual property? Talk to the agent first, but it should be a short conversation of you telling them to get it off your property and them apologising for putting it up on your property.

        They can probably put it up on common property, but you can probably ask them to put it somewhere that doesn't affect your views/etc.

                If you own the fence, give them 24 hrs written notice to remove it, then if not removed, DIY.

                if you don't own it, tough.

  • Our strata by laws are the sign can be up one month before and two weeks after. I don't think there is any requirement to notify anyone.

    If it's on your property send them an invoice for payment.

    Call up the real estate
    Tell them you realise they probably didn't know, but their sign can't be placed on your property, that you didn't authorise. Tell them where to move it and tell them they have 48 hours and after that you'll be charging for removal.
    Follow up with an email to confirm in writing what you have told them.

    Worked for me every time.

  • RE won't talk to BC and don't care about anyone else but getting the sale.
    Rip it out of the ground and put it out of the way if the RE ask you tell them to put it on the owners property.
    That's about as far as it will go.

    My understanding is a real estate sign like any other is not permitted in a residential zoned area.They are tolerated by councils but have no legal right to be placed there not even on your own property.

      I had to get a permit to put my own signage up on my own building so I suspect you're spot on.

    None, they are moving out, and 24 days of conflict could be ahead for you if you stir things up They are moving out, so they potentially have no reason to act civil and get along with you in this final period. Sure they should abide within law, but there are plenty of things they could do to annoy you, without breaking law. Best just not worry about it.
    Sounds like it is out front (on council property) , so if you must, contact council and ask them about it and whether they are allowed to have this sign there.
    It's hardly a big deal. Honestly, if you were selling your place, you would probably have a sign there, and maybe they would not particularly like it being there.

    Edit If you have nothing better to do, and want to start trouble of something relatively minor and petty… Well I guess go ahead, but be sure to keep updates on ozbargain. This could very well provide us with some much needed entertainment. Re. What your neighbor does next in retaliation. Tit for tat type petty BS leads to more tit for tat type petty BS. Would be entertaining for us to read about though :)
