DWI Warranty Help

Purchased 2x Samsung Fit2 Pro from https://www.ozbargain.com.au/node/354476 and one of them now does not start up. I have tried the 7 seconds, connected to laptop, using a different known working charger (since I purchased 2), and different plugs etc and it still would not start up.

Contacted DWI and they requested a video. Sent the video, they are now requesting for original packaging.

Who keeps original packaging after 9 months?

I assume there is nothing i can do now that they are refusing RMA based on no original packaging?

    Warranty issues like this are the exact reason why I do not buy grey imported products - I would rather pay a little more and not be screwed by dodgy stores.

  • Consumers have the same legal rights to a refund, repair or replacement whether or not the goods are returned in the original packaging or wrapping.

    DWI would know the rules by now - but they constantly show a disregard for Aus consumer law in the hope that you give up. They do not respond to Fair Trading. They are a law unto themselves. I would avoid next time.

    Not required, you're not making a warranty claim which could have all sorts of requirements, you're making a claim under the ACL which doesn't have these requirements.

    They can request it, just tell them you don't have the original packaging and that you don't need to have it in order to request a refund/replacement under the ACL.

    I know alot of people are quick to jump on the acl and accc bandwagons but dwi arent based in australia.

      I actually went to (kind of) check - they do enough business to Australian customers, with enough references on their website that specifically shows they target Australian customers, that they'd be bound by Australian laws and regulations imo. OP's risk in buying grey-market goods is losing out (potentially) on manufacturer warranties, it doesn't affect their legal rights under the ACL if the seller is prima facie an Australian one.

        Everybody is supposed to be bound by it.

        • Correct, and… kinda correct. Everyone who "does business" in Australia. So DWI in this case? Definitely. But say, an American company that only delivers to the US that OP buys from and then gets the product forward-shipped to them, likely not.

  • DWI can be a pain.
    Ask to speak to a supervisor.
    Explain that you require the Samsung product be repaired under warranty and that the box is not required.
    Failing that,ask who to contact at Samsung.
    With DWI,it's more a matter of fluking the right person.

    • You can't speak to someone for a DWI warranty. It must be via email. Expect one sentence answers that appear preprogrammed by a bot created in 1997.

    • Yea, quite sad with this mob. I have been done with 'overseas' Samsung phones before that Samsung refused to honour warranty because it doesn't have the Austick. I thought i did enough checks to confirm Aus Co, but yea, no ABN.

  • They are the worst, don't buy anything from them.

    I sent my phone back for warranty issue in May 2018. They fix that issue but it has another issue so i sent it back. They said they fixed it and send it back and it is still not working. I had this issue since May and i need to send my phone back, this is the third time

  • now they say they dont provide manufacturer warranty, and water damage is not covered. requesting me to pay money because it got sent back. this mob is the worst.
