Purchase Item from eBay (Reimbursment)

Hello,
I made a purchase through Ebay a month ago. I recieved a used item(I bought new one) and I raised it in front of the seller, he suggested to replace that specific part in the item that was apprantely "damaged" during shipping.

A week past and then I find out that the motor stopped to operate.

I raised it in front of the seller, he suggested me to ship the item back to him and that he will replace it.

He sent me a shipping label and asked me to place it on the item box, and someone will come to pick it up.

After few days he sent me pictures of the item completely damaged and said that the shipping is not insured, and because of the item condition they are willing to only reimburse me for half of what I paid(~150$)

What are my options in that case? Should I refuse and open a case in Ebay or should I agree to his offer?

    Raise an Item Not As Described complaint with eBay and you should get a full refund. On such issues they normally favour the buyer

        That shouldn't be an issue.

        Normally you would go to your purchase history, hit the 'return this item' button next to it in your purchase history, and then choose the "doesn't match description or photos" reason. Document the run-around you have been given (even copy and past the messages between you and the seller prior to opening the return case", and include some pics if you have any you took of the item condition before you returned it per seller instruction… Then it's up to the seller. If they keep giving you the run around, you'll be able to ask eBay to review the issue, and they're likely to promptly give you a full refund.

        I'd still try that now, as you can still get eBay to review the case and see what they say. You could also open a dispute through the resolution centre (hover over username on the top left -> Account Settings -> Resolution Centre (bottom of left sidebar)) due to "I received an item that does not match the seller's description.", but I think that basically walks you through the return process anyway with a different interface. If push comes to shove, open a PayPal dispute if you paid with PayPal. But I don't think you'll need to go that far.

    You should not have sent it back to them without there being an ebay or PayPal case telling you to. If you no longer have possession of the item, eBay will probably not help you but you can try contacting them just in case.

    As long as your correspondence has been through eBay messaging you should be okay to request a full refund by opening a case. EBay will be able to see the trail of discussions between you and the seller. You may however have problems because you did not return the item to the seller immediately after receiving it and some time has lapsed since first use.

    You may be better to discuss with eBay through the chat line first and see what their thoughts are. Generally they are non committal however it is worth chatting to someone and if you don’t get far with the first person ask to speak to a supervisor.

    If the item sent to you was a used and not new one then you normally have the right to a full refund as the item is not as described. However did your first discussions with the seller mention this? It is important as eBay to help you needs proof of item being used and not new.

    The other option as it may be a bit of a battle and will need quite a bit of time is to accept the 50% amount and post negative feedback advising that the seller sold you a new item but sent a used item.

    Note with any cases you need to allow between 3-5 days for replies and it can drag on for about a week or two before eBay will step in and make a decision. Depending on the skill of the seller they may be able to get out of refunding you the full amount because they can say you used it and then modified the unit before return shipping even though they asked you to because you may not have modified it correctly as per their instructions or did not replace the parts/covers which caused more damage. They could also argue that you did not repack the item securely which resulted in more damage upon return. You will need photos and video to prove this is not the case.

    On the returns section it's saying not accepted.

    • You will need to do this on a PC. Or if your android web browser allows, request desktop site.

      Even if it says returns not accepted, if an item is not as described then it is still possible to return and receive a refund. You just need to open a case and state the issues and why a full refund is valid. Write in a non confrontational way and seek to have the buyer understand your explanation. The more you show that you are trying to work with the seller the higher your chance of success.
