Chargeback PayPal Transcation

Bought a phone online, keypad is in Thai/English not just English as per photo and title.

Tried contacting website, no response.

Raised PP dispute, they decided in their favour within a day even though I attached screenshots/proof.

TLDR: Has anyone tried chargeback with a AMEX for a PayPal transaction? Will PayPal ban hammer me?

  • Your only choice now will be a chargeback via your CC. PayPal will likely closed your account if you do this so make sure you have no funds sitting in there.

    Did PayPal give a reason for the resolution in their favor?

    Do you have a link to the website / phone?

    • Just called them and they couldn't give me a reason and they have escalated it to have another check done.

      I do, I took a screenshot of the page with the phone when I bought it (had a hunch) and the title never said keypad may comes in other languages.

      Now they have changed the title…

        I love the update (keypad may comes in other languages), so a lucky dip as to what language you get.

        I would do as Drew22 suggests re unlinking your accounts, clearing out funds etc…

      • Next time, use https://archive.is. Screenshots can be doctored. A third party is more trustworthy.

    Remove funds from your PayPal account first, unlink all bank payments, charge back and cancel the linked credit card.

    PayPal will probably close your account with them, and try to charge your bank account directly or credit card if its still linked.
    They are little cry babies about doing the right thing by customers, worse than the common thief if you ask me.

    I'm not seeing the problem. There's still English on the keypad, right? You can still read it, still use it? There's just extra Thai characters?

      Correct, the size of the letters have halved compared to English only keyboard.

      Is for a elderly person, don't want them being confused about what letters they are pressing.

      • Ah. That's a valid complaint. Did you tell Paypal this reasoning? Basically: The item is for an elderly person with poor eyesight and you bought it because of the large letter font per the photos - and the item delivered had far smaller lettering making it a significant difference?

        • @apptrack: That's a tough one. The link you provided above - only the description was updated, not the photos right? From what I can see, the english lettering in the photos are about half the size of the numerals. The english lettering in the item you received is still half the size of the numerals. As far as I can see, the only difference is the addition of thai lettering.

          You still might have an argument that the one you received is more confusing, but I don't like your chances from that photo.

          If you can't get a refund, is it possible to just scratch off the thai letters with say, a box cutter? Obviously not ideal, but you'd end up with the same phone as in the photos.

          That's fair enough, if it was for me wouldn't care, but for an elderly person it might get confusing.

          Don't think I'd be able to scratch it off, plastic is quite soft.

        • @apptrack: Yeah - good luck with the appeal, and just stress that this is for an elderly person and you bought it specifically because it looked simple to use with clear lettering.

        • @apptrack: Ahhh tough break. Though in tech I think this happens on a daily basis so you're probably not alone, even if your particular case is… unique.

  • when you say you 'raised dispute'.. was it 'item not described' or u went to full dispute/i want my money back right now mode?

    if it isnt as described i would guess paypal would give you the option to return it for a refund? cause it wasnt originally listed as having a thai/english keypad then it wasnt as described

    • "Not as described" would mean Paypal made the right choice as their T&C reads out.

  • Paypal can and probably will come after you with a debt collector

    One of my exes had a chargeback on PP and went into -$100 and a few weeks later had debt collectors calling

      Like other companies, they will sell the debt to collectors.

    Not with Amex only Visa, and no, they wont ban you for 1 chargeback.

    I'd save the chargeback as a last resort.

    What I would do is:

    Contact PayPal, and ask them for a review or supervisor.

    If that fails, lodge a claim with the financial ombudsman, PayPal wont bother defending it and will pay out.

    Or a chargeback.

      most companies drop a brick when they see a notice from the ombudsman.
      used to work at MSY after their first hit every time a customer mentioned anything like that the manager would immediately agree with them.

    Yeah I had a non delivery once, Filed dispute with first eBay and then PayPal, both found in favour of the seller because it was 'delivered' even though no proof of signature or to what address.

    In the end did a Chargeback through CC and whilst was only about $20 was nothing further from it. Still shows in good standing with PayPal etc…

      Not possible, you can only do one claim.

      You only need a signature if the value is over $750, otherwise the seller only has to prove delivery to your suburb.

      • Yes it is possible, raised it with eBay, then after that was closed was able to raise with Paypal.

        No again seller did not have to prove delivery, only had to prove it was sent and that was good enough for eBay / Paypal, they then confirmed with tracking to see it was delivered and said it was delivered.

          Technically you can, but the other case will be automatically closed so it's pointless.

          From PayPal:

          If you file a claim with PayPal while an eBay claim is open your eBay claim will be closed and we’ll then proceed with your new PayPal claim instead.

          seller did not have to prove delivery, only had to prove it was sent

          How long ago was this as the seller must prove delivery.
          This was changed a few years ago when the seller only had to prove they sent it.

          Correct so once the eBay claim was closed, I then opened one with PayPal.

          It was approximately 18 months ago. When I asked for proof of the signature through dispute process I was informed from both eBay and Paypal that the fact it was delivered was all that was required and sided with the seller.

  • Just a reminder that for eBay items, the image, the photo means very little. It is the description what really counts.
