Received Refund from eBay after No Seller Communication AND Now The Item Has Shown up...

The title I think is pretty self explanatory.

During one of the last 20% off codes on eBay in mid July I made quite a considerable purchase of an item from a seller with 4k+ feedback, that as far as I am aware was in stock according to eBay.

The order was placed on the 13th with expected delivery by the 20th of July 2018. That time frame came and went with no development in the order, so I first contacted the seller to see what's going on and had no reply from themselves so being out of pocket several hundred dollars and no reply from the seller I escalated with eBay. I still wanted the item and that's the option I chose when eBay asked what do you want to do. So during the time frame that eBay gives to the seller they didn't reply to that as well. So eBay decided in my favour (no tracking number was provided by seller) and a full refund was issued which I now have.

Now a week later the item has shown up at my door step, what do I do?

I see my options as either;
a) Contact eBay and see what they say.
b) Deal direct with the seller. (Not sure if this protects myself from any further issues, so I'd rather try option a)
c) Keep it and do nothing, not my fault the seller appears to be rude (not replying) and incompetent.
d) Teach them a lesson for price jacking during 20% off sales. /s

Also I have not had any contact from the seller as of yet but I'm sure this will now suddenly change.

TLDR; eBay gave me a refund of several hundred dollars and now the item has turned up, what do I do?

  • Contact eBay and CC the seller.

    If you return the money to eBay, eBay may not be honest and pay the seller. Make sure the seller knows they are meant to see the money.

    Did you have to sign for the delivery?
    If yes, contact seller and tell them to collect / arrange for return of item.
    If no, up to you.

      But OP wants the item and is seemingly happy to pay for it. So contact eBay to arrange payment, basically.

    Was it drop-shipped, hence the delay?

  • Perhaps the seller has had personal issues, health issues or family issues. Don't be too quick to judge.

      Perhaps eBay has a bug in their message system and the seller ended up being penalized for what was eBay's problem, and now OP is trying to be honest and ends up paying eBay. eBay is unlikely to pay the seller to avoid raising a problem they may have successfully buried.

      Just saying, eBay isn't a stand up citizen.

    Send the seller a message directly, you could pay them through PayPal. If they don't respond then you can feel like you've done your due diligence

  • Definitely contact eBay and the seller. Even though the seller seems to lack the necessary and timely communication skills required to conduct business through eBay, it doesn't discount the fact that you have accepted goods for which you have received a refund for not receiving. It might even come under an "obtaining goods by deception" or similar law. For the sake of your conscience I think you should make a reasonable attempt at contacting eBay and the seller to return either the product or money.

    Perhaps email the seller directly. Maybe the eBay messages didn't go through to their email.

  • After 3 months when the seller doesn’t arrange for recovery, it urs I believe. I think it might fall under the unsolicited goods. Either way best to do the right thing and contact the seller.

    Put urself in their position. I wouldn’t want to lost the item, time and have nothing to show for it.

    Just because a seller didn’t respond, they mightn’t of been rude btw. Lots of possible reason for it which isn’t the seller fault.

  • Always do the right thing. Either return the item and keep the refund, or keep the item and pay the seller. There are plenty of reasons the seller may not have contacted you (eBay’s systems could have failed or the email may have gone to an unmonitored inbox). Even if it was poor form on the part of the seller, that’s no reason not to pay someone for goods you ordered and received. There are mechanism to deal with the delay and lack of communication (feedback, etc).

  • The right thing to do is to pay the money back to the seller. You can contact ebay directly and explain the situation if you like but they would have closed the case, made a strike against the seller and noted this in their system.

    Really bad communication from the seller but if you got the item in the end and it wasn't damaged, didn't cost you any extra than you initially paid then I would just PayPal the money back with a note.

    If it was you on the other end of this and for whatever reason you couldn't have contacted the buyer to get in touch yet you got the item out in the end, wouldn't you want your money?
    This is totally up to you but everything seems to come back around.
