Workplace Smoking - What to Do?

Hi,

My next door neighbors at work have their smoking area right next to my work area, i don't like this.
They have approx 20 people during the day out there smoking, max is about 8 at a time.

We get along fine as work neighbors and I want to stir the pot as little as possible.

Does anyone have some diplomatic ways to solve this?

Or any ideas on OHS smoking laws I could politely point out to them?

Edit 1: I unload shipping containers right on the fence line, the smoke wafts into the containers when im working!
No there is no where else to put them for us.

  • How closely do you work next to the fence? It seems to be a big open area - do you think rheycould put the smoke area anywhere else? Would you be willing to pay the cost to move the space?

  • If it's private property that belongs to them, I'm not sure there is much you can do. Unless there is another spot on the property you could gently suggest they try?

    If they are a tenant you could complain to their landlord, but you would have to find an appropriate law to back up your claim.

    Not sure if you are the owner of the business you work for, but if not, you could make it your manager or boss's problem by complaining about OH & S so they can try to find you an alternative work area or negotiate with the neighbours themselves.

    Leave some open bags of fresh manure by your fence just in front of smokers area

    • This might work. Just leave them there for a week or so. The smokers will find a new area to pollute the air, then you remove the manure and hopefully they don't return.

    Do you work outdoors? If indoor, I'd quit the job. Have you tried raising it with your friendly OH&S officers if they've considered their potential liability for exposure to second hand smoke?

  • Why do you work in an open area right next to the smokers? Looks like you work on the road! Do you plonk a chair in that spot every morning?
    Can you move a little bit up or a little down that road?

      Ebay a $6 vape starter kit, cheap local juice without nicotine. Vape away. They'll snigger but eventually ask questions.
      When they learn their nicotine habit can be just 5% of their ciggie spend, you'll probably convert them.

        They actually do have someone that vapes…he brings his own reclining deck chair to work each day and packs it up after every break.

    Smoking is banned in all public places, shared areas and workplaces that are enclosed or indoors. Banning smoking in enclosed public areas protects the community from the harmful effects of passive smoking.
    What is meant by enclosed?

    An area is enclosed if it is fully or partially enclosed by a ceiling/roof and walls such that the combined area of the ceiling and the wall surface exceeds 70% of the total ceiling/wall space.

    Materials such as shade sails, umbrellas, shade cloth, lattice and louvers are all considered to enclose as area as they restrict airflow.

  • so you stand at that spot all day?

    • No, maybe once a week i would be there unloading a shipping container for 8-10 hours of a day.

      Approx 400 hours a year of passive smoke inhalation.

  • You might be able to get your employer to arrange for a more solid fabric over the fence, like heavy plastic dropsheet, wired in place. That would block most of the fouled air from blowing onto your side.

  • Are you able to play music while you unload? Specifically Classical/Opera Music.

    at my first job a few years back, the offices designated smoking area was about 30 meters away from the building entrance but nobody smoked there due to having to climb stairs instead they loitered/smoked next to the entrance door even though there were no smoking signs.

    Building management solution was to play classical/opera music in the areas where there was problematic smoking at the level of normal talking(i think 60db) it stopped about half the people from smoking/loitering/talking and having multiple smokes. It didn't totally solve the issue, they just moved to another place where there wasn't music playing but a good outcome for preventing smoking next to the door.

    so long as it doesn't bother you, im assuming if they are allowed to smoke on their side, you are allowed to play music on yours, maybe some of them will get annoyed and stop or limit time there?
