Can We Cancel Job Offer after Signed The Contract?

Hi guys, can you please let me know your thought or if you had the same experience in the past.

I had signed a permanent job offer but I have been advised today that another company also offers me a position with higher salary, though they still need to do the reference check first.
I have checked the contract which I had signed it only mentions I need to give notice a week during 6 months probation.
If I cancel the first job offer, will I be in trouble as in the company can sue me due to legally binding agreement?

    No they cant sue you, but they will not like you at all.

    They won’t sue you, however you don’t have the other job yet.

    I have known cases of people accepting a job, working 3 days, then quitting to pursue a better offer.

    You aren’t a slave - you can go whenever you want. The 4 weeks thing is more of an issue for people with accrued leave, if you didnt give notice they can keep that leave as compensation. Don’t quit until you’re sure the other job is better - money isn’t the only thing you have to like about a job (career development, culture, industry, specific role experience, etc).

    Probation isn't a one-way street - they're evaluating you, you're evaluating them. The notice period depends on the award (usually 1 week), but it looks like you read your contract. If the employer has written it entirely in their favour ("you must give us 4 weeks, we can give you 1") then my opinion is you have a pretty good case for ignoring that. (Employers can say you'll never work for a competitor for 2 years, give them your first born son.. but in reality very little of that is enforceable)

    They'll probably be angry - now they have to waste more time asking their second and third choice, maybe re-advertising. You can be sued for anything (unlikely to happen here) but I'd be more worried about your reputation: if it's a small field, starting then immediately quitting isn't ideal. But in reality you'll quit, they'll be frustrated, then hire the next guy/girl and forget about you. Have an honest, business-polite conversation with them ("an amazing opportunity came up that's great for my career") but don't let it stop you if the new job sounds better.

    You are the commodity
    Be confident and thank them for their opportunity but someone else has offered you a higher pay and better benefits.
    If you do it well, the first company will raise their offer to keep you.
    That is negotiation

  • I'd be very careful about re-negotiating now with the first company - from what I've read when I was negotiating my salary this does not usually end well.

    "Sure, I'll accept - thanks!"

    (Wait a few days)

    "Actually, I want more money" (or I'll change my mind)

    (Wait a few more days.. will they try this again? Or just quit?)

    You've likely missed your chance to negotiate unless you're particularly good at negotiation (most of us, myself included, are not).

    TBH, I wouldnt turn down a job offer based purely on salary.

    Benefits, experience, work / life balance, commute times……

    If you really like the second job better (not just salary but also other factors), then wait until you've got an unconditional offer from the second company before you tell the first company that you won't be starting there or resign (if the second job offer is still conditional when you're due to the start the first one).

    Never, I stress never, should you give up an unconditional job offer (or your current job) just because someone else has given you a conditional job offer. A conditional job offer is just that. It's subjected to satisfactory background check etc by the employer, which is at their discretion to define what satisfactory means.

    Thank you everyone who gave all the suggestions, I have decided to stick with the job offer which I had already signed due to better career progression and the experience.
