Not Given a Way on a Pedestrian Lane at The Shopping Centre, Car Just Hooned Away: Should I Take Action or Suck It up?

Okay so I was walking at the underground car park of Westfield Carousel (WA) and about to cross (stepped on it) using the pedestrian lane, and this car (?1998 Mitsubishi Lancer 2 door paint faded) driven by a P plater with 2 passengers (1 of them is a kid) just hooned all the way forward. The car's distance is still about 10 steps away.

When the car passed I shouted "Oi, it's a pedestrian lane" and she just shouted "Oi" and driven away.
I hopped in to my car and came nearby her and said "You should learn learn about the road rules" then she kept on saying racist chants and all.

I'm just concerned about her personality and driving, especially being a P-plater on the car park and having a grade school passenger. It could result in to worst things and good thing me and my friend stopped walking suddenly. Imagine what else can happen to other people?

I've searched about it's penalty and it is 3-4 demerit points + $300 fee (if not mistaken) on WA road rules.

Any thoughts about what I should just do? I've opened a poll.

    Well read this. I am an ED RN (in my hometown) and the amount of people who became partially/fully paraplegic/quadriplegic is high on bad MVA's. When I went on a rehab ward here, being a student, there was a lot due to MVAs.

    I also got a friend who had an MVA and is now paraplegic.

    This is the reason why I am pissed off with the incidence.

    Did this incident happen on private property in a private carpark???

    • I've search but I'm not sure if it applies as it's in the westfield parking. I was thinking it will applies tho it's considered as "road"? Unsure. Cause in general we still have to followe where there is a pedestrian line and cars should give way.

        The road rules apply to roads and road related areas. The latter includes carparks.

          Australian Road Rules, Part 2, Division 1, Reg. 13, Subrule 1, part (d) says:

          1. What is a Road Related Area
            (d) an area that is not a road and that is open to or used by the public for driving, riding or parking vehicles.

          And in case you still don’t get it, it is covered again in Reg 26

At the very least, they would take a complaint regarding a dick-head act from an apparent yob in training, and if more than a few came through, perhaps have an educative word before the lass ends up losing entitlement to a vital part of finding employment…

    I votes yes, bogan behaviour on the road is just dangerous .. eg not indicating b4 lane change/turn, entering roundabout at high speed, not giving a fk on give way rules, if they had hit you would they even have a valid licence and reg'd car?

      That's what I first thought too, I've encountered alot of people stopping rapidly when they saw somebody crossing even when they are going fast. But then, just this concerns me more as it's a danger to the community as the driver just hooned all the way even seeing a pedestrian ready to cross.

    • Yes this is a big concern. If you, your friends or other family members get strucked by a motor vehicle and has caused them chronic problems. Will you get mad about "stupid drivers"?

        I get where you're coming from, but this is one out of hundreds or perhaps thousands of these types of incidents daily. How much time do you have in your life to give up to spend time writing up a statement each time something potentially dangerous happens?

        The cops are unlikely to even care about the incident. Westfield is also unlikely to provide you with the footage given there was no actual incident.
        So why waste your time?

          Yes that's the reason why I am asking if it's worth to take futher action. For me, it's fine but then I am concerned. What if others got strucked? Think about your mother or father got "somewhat" hit and caused a small fracture or a wound even at least? Would you be mad? Would you ask for evidences to chase the one who did it? Or will you just be "Mum and dad, get on with your life".

          I care about the community and other people. Not just myself, thank you.

      I'm asking for opinions. Basically if this is possible to be taken further action then the "driver" would possibly change her behaviour and reduce chances of having accidents. On the other hand, should I just let it be and whatever incidence that happens to other I wouldn't bother because it's not me.

    Carousel…This is not the Queens carriageway.

    This is private property and the Queens W.A road laws do not apply.

    Road rules only apply on the queens carriageway in this state.

    • That and the fact that we don’t know if the pedestrian crossing is laid out to the Australian Standards and correctly painted and sign marked.

      For anyone who actually cares, the Aust. Standard for pedestrian crossings is covered in AS1742.10-2009.

      That's just untrue. The relevant information has already been posted, but I'm shocked there are people out there who believe shopping centre car parks are immune from the law.

    I commend your concern at this being the exact sort of driver attitude that ends up killing someone innocent, but as you can see the complacency and lack of real action that can be done is hard to change as well.

  • Police would love nothing better to do than devote resources to investigating this traffic offence rather than attend domestic violence incidents, assaults with injury and break and enters.

    Shopping Centre won’t give you the footage, if it even exists. Police won’t really give two rats arses about it. Bogan driver doesn’t care and a ticket won’t solve anything. This happened on private property, so the regular road rules don’t always necessarily apply. Don’t know the crossing you are talking about, but is it set out to Australian standards and signposted correctly?

    You are all bent out of shape over a dumb arse bogan doing what they do best, being meth chugging morons. Consider yourself lucky you didn’t get hit and injured, and put it down to life experience. Chasing them down in your car could have had much worse consequences as well.

    Let it go and move on with your life. The shopping centre won’t care, the police won’t care and the bogans won’t care. Karma will catch up with them eventually…

    Go to the police mate, a woman was hit and killed by a hoon at a shopping centre car park pedestrian crossing here in Victoria not long ago. The court case was in the news and everything, very sad loss of life due to stupid operation of a vehicle. Said vehicle was one of those dumb little monkey bikes but still the same thing could have happened to you. A lot of people will say this is a waste of police resources since you were not struck and killed, but if you have the time to spare, go and do it and they may chase it up. It's little things like this which help set examples for the community. The shopping centre will give you the footage if you file a police report, as I have found out when someone hit my car.

    what I tell my family is that especially in a car park or at a crossing cars may or may not see you…
    - it is easier for a pedestrian to avoid danger than a car
    - assume cars cant see you and only cross or use the roads when it is safe.
    - don't assume that just because the pedestrian has right of way that a car will give way to you.

    if you get hit by a car on a crossing… who really losses out.. its the pedestrian. death or serious injury. person in car may get a fine may get charged for endangering but you dead so in reply to you OP.. be careful and be thankful you didn't get hit and you cant cure stupid.

    same goes for if you are driving… just because you have right of way doesn't mean a pedestrian wont step on the road in front of you. always exercise caution in heavy pedestrian areas. what is the worst that can happen, your car gets dented from an impact with a pedestrian that wasn't looking, they die but you have to live with the guilt that someone was stupid,

  • I don't think authorities care unless someone was injured. I almost got ran over yesterday due to a driving running a red light. You'll just have to walk it off and be aware/avoid these dangerous drivers.

    Police have absolutely no jurisdiction on private property when it comes to cars. Nor do rangers.
    And I have never heard of any shopping centre taking action against a customer.
    After all, all business is good business.
    Most they will do is provide footage if there has been an injury or any damage.
    OP needs to toughen up because much more serious things will happen in life and we wont be there to help.

      Police are police, they have jurisdiction almost everywhere in the state to enforce laws, as for the laws, I previously thought this too, but there was a rather convincing comment that would say this is not true near the top of this post from pegaxs:

      It makes sense because I am fairly sure you would get some penalties from the police if you ran someone down on a shopping centre pedestrian crossing then drove away…. and that comes from road rules regulations despite not being the road itself.

  • Definitely a road related area.

    Police aren't going to act days after the event, given no one was injured and it's only your opinion that the car was 'driving badly'. Not saying they weren't, but rather hard for police to act on your say so.

    Footage might show something, but again probably not enough for police to act. You might get lucky if there's a decent camera right there at the crossing, pointing the right way.

    If it's that bad on the day of the incident, call 000; record video on a phone; read out the plate and car make/model onto the recording.

    If their driving is that bad, they'll stuff up soon enough and earn some nice tickets.

  • Not worth the effort. Plus, without evidence they won't cop any demerits or fines, and the police aren't going to go through CCTV footage for a traffic ticket.

    There is only 1 parking area that is under cover "underground to you" at the moment.

    So you are saying that this occurred on the ground floor of the new multi story car park building with 700 plus parking bays with entrance off Liege street.?

    So this occurred inside a large building which happens to be a multi story car park on private property at one of the crosswalks installed by westfield, and probably the crosswalk that heads towards the Coles and Kmart general entrance area.? yes? no?

    This crosswalk is inside a large building on private property.

    Repeat inside a large building on private property, not on the queens carriageway….
