Names to Be Removed from Rental Lease

Hi there!

Was advised by our Rental Property Manager to forward him an email advising him that myself and my partner would like our names removed from the rental lease ( we live with someone else but they will stay on).

Is there some sample letter I can work from? This guy is super picky and just want to get it right first time instead of him emailing me 10 times.

    Try this:

    To whom it may concern,
    I’d like to advise that my partner and I would like our names removed from the rental lease of the property located at X Address effectively from Date.
    We currently live with Someone but Someone will be staying and continue with the lease.

    Just send him a letter, if he’s not happy ask him how he’d like it and change it accordingly

    Send them a email and BCC the office of the realestate you are with. Also CC your housemate. Just incase the agent leaves and your house mate is left in the dark or you are somehow still on the lease.

    Dear <agent name> ,
    As discussed with you on the phone I will be leaving <address> along with my partner <partner full name>. Therefore effective from <date> I would like to have my name and my partners removed from the lease agreement.
    Any further correspondence about the property should go to <house mate> who is also listed on the lease. Incase you don't already have their details, their email address is <[email protected]> and their mobile is 04xx.

    I would appreciate you updating your records effective immidately with <housemate>'s details and also please respond to this email to confirm you have received it.

    Should you have any further queries please don't hesitate to contact me on 04xx

    Great letter above…

    An email may not be legally binding so I would get it printed, signed and delivered to landlord and/or agent.

    You will still need to give notice. Immediately may be acceptable depending on your contract but you'll probably need to give normal month notice. As long as you've paid the rent for the coming month you shouldn't have any further liability if your notice is accepted. If your notice to take your name off isn't accepted maybe as your housemate may not be able to afford the rent then you'll have to end the whole tenancy and your housemate will need to apply to stay on or find somewhere else to live.

    • An email can be classed as legally binding if you have established that email has been used as a form of communication.
      However, to cover bases I would put in the postscript of the email - I have also formally sent a signed letter in the mail.

      • The agent actually advised that all 3 of us must email him to confirm me and my partner want our names removed from the lease- these were his instructions. :)

    I googled this phrase: "letter for removal of name from rental lease". You can just remove the bit about the new tenant, as there is no new tenant.

  • I have submitted the email about removing our names from the lease and also have given notice to vacate. The agent advised 28 days but i included this in the email. I have always rented my own place and leaving was pretty straight forward. Let just say
    D.H (dirty hag) is staying on and good luck to her. I hope she finds dirty people like her to move in!

    She is now responsible to find 2 new people…does anyone know what happens to our bond? The thing is on our last day at the house we will leaving for overseas..is there anything else we need to settle before we leave? I just don't want to check emails whilst living the dolce vita in Italy! Hihi

    • I think the remaining tennant will have to go in and sign a new lease and pay the remaining bond.

      I don't think it is as simple as just telling the agent that you are leaving, you have a contract with the agent and the ways of getting out of it are detailed in the contract.

      You will remain on the bond until a Bond Transfer form is completed, i.e. when new person moves in or current person, pays out your bond, and you all sign to get you off the bond.
