Disobey No Stopping Sign fine by Kogarah Council (NSW)

Hi OZB,

I received a mail yesterday having infringement notice of $257 for Disobeying No Stopping Sign.

It doesn't provide the picture or any other evidence and shows the date of offence more than 20 days back. I don't recall it. Is there a way to find what I did wrong? Doesn't council provide evidence? I assume if its taken by a camera, there should have been a picture.

This is my first ticket so please pardon my ignorance.

UPDATE - I called SDRO but they don't have the picture nor the council has the picture (called them too). Rep on the phone from council tried to contact the ranger unsuccessfully and took my contact number for ranger to call me later. I am waiting for that call.
I have left an enquiry as well with SDRO website asking for evidence but it said the processing time is 28 days. Not sure I can wait that long since the payment date is after 12 days from now as :(

  • You have to contact them for the image.

    • Can I just ask for the picture and they will provide it? I don't see any camera on that street.

      • You can send them an email and ask them that, you want evidence. Provide them with your ticket number and other relevant information. The image will either be from a dashcam or phone.

        So you've been back to the street, there's a No Stopping sign there, but you don't remember stopping in that location 20 days ago? Is your memory really that bad?

    What did they say when you rang them?

    • I rang SDRO after seeing your reply. So, thanks mate. They don't have a picture and asked me to check with Council. I rang up council they don't have the picture either and they told me that they have asked the ranger to ring me. I left my phone number with them.

        OP might also be confused and think it was about a stop sign.

        • I did indeed! I took 3-4 rounds of the premier street after I got the ticket searching for that eluding Stop sign. But, I understand it is for the No Stopping sign as others have pointed

    • Sorry hi, yes missunderstood it was stopping sign, not the stop sign.

  • Are you the only driver of the car? if not that may explain why you cant remember doing the offense, do you have a partner, wife, husband etc that uses teh car

          I didn't. I double check always where I park. If I have an iota of doubt I don't park there.

    Did you call them and ask? Or did you think maybe somebody on Ozbargain works for Kogarah Council and would see this post and give you the specific answers you need?

  • My understanding is that Rangers book cars parked in a No Stopping zone but they must take a photo to prove it.

    If it is not fully stopping at a STOP sign at an intersection - only Police can do this and they would chase after you.

    • AFAIK there is no requirement to take photo evidence to prove it. The Ranger's witness account is enough. Sure, a lot of them do take photos now because it saves arguments later, but it isn't necessary.

    Kogarah Council rangers are notorious for booking cars that are parked or stopped illegally. The big money earner is outside schools at both drop off and pick up times. If you do a school pick up or drop off then in all likelihood this is when you have been nabbed.

    • It shows on Premier St and this is not in the school zone.

      • You have obviously pulled over in the street (in a no stopping zone) for a few seconds and the ranger has seen that and immediately taken a photo. This does not surprise me one bit. Fighting it will fall on deaf ears.

        • maybe but I don't recall. Shouldn't they provide the evidence? I rang up council and they said there is no photo with them. Ranger would give me a call!

    If they have no image, you will be able to argue lack of proof and waive the fine.

    • I don't think they have image. SDRO didn't have and they gave council's phone number to ask for image. Council on phone said there is no image and he is not able to reach the ranger so took my phone number.
      How can (the process I mean) I argue lack of proof and ask for waiving the fine? Should I call SDRO and discuss this? or apply a review citing lack of evidence?

    It is your legal rights in nsw to have a penalty notice either reviewed or have it decided in court. The issuing officer may have to provide evidence to support their claim that the driver of the vehicle committed an offence.

    Its pretty obvious to me. The offense is that you parked in NO STOPPING AREA.
    Note if you park within 10m of any corner its the same offense. The notice should have the time, date and exact place of infringement

    • The notice does have the time, date and the street name. But, I am asking for image as I don't recall. Are they not required to have an image as evidence?

    • they shared the image and I paid :( Apparently I had stopped for 2 seconds to drop the missus.
