Motorcycle Insurance Claim Kerfuffle

So I wouldn't bore anyone to death I'll make this very short.

  • 6 week old motorbike was involved in an accident while it was parked on the roadside. It was clearly established that the other party was at fault.

  • A claim was made with the insurer of the other driver and the bike was taken to the bodyshop which belongs to the same dealership I purchased the bike from. They came up with a quote(parts and labour) and was approved by the insurer and the bodyshop claimed they are in the process of ordering the parts (all parts are from their own brand's supply chain)

  • Later it was discovered that there is more damage and it wasn't economical to repair the bike and it was deemed a total loss.

  • The insurance offered a settlement and deducted a certain amount from the total settlement for me to salvage the bike myself and I took that offer.

  • The bodyshop claims they ordered parts based on the insurer approval and these cannot be returned any more - This morning they asked the insurer to pay and take ownership of these spare parts and currently waiting for a response.

  • I went to pickup the bike this afternoon and the workshop(belongs to a 3 letter prestigious brand mind you) refuses to handover the bike unless the parts are paid for (by someone I guess)

I'd hope the insurance would pay up and take ownership of these parts but even if they didn't can the workshop refuse me picking up my own bike based only on the fact that the parts(that never got used) aren't paid for? How is that going to be my problem as the quote was submitted to and approved by the insurer?

    This seems quite odd considering that your insurer approved those parts based on the workshops first assessment. I don't see how its your insurers problem. I really think the workshop is in the wrong here.

    Could a moderator please close this thread as the issue got resolved pretty fast!

    I just got a response from the Insurer and they are settling the parts invoice tomorrow. In their response to the body shop they clearly expressed their surprise why they went ahead with the ordering without even pulling the bike apart(which they still haven't done I've been told) so the exact damage could be clearly determined. Nevertheless they will be paid - Free money for them I guess. Wonder what would happen to parts worth $1500 as the insurer has not expressed any interest in retrieving them.

      Ask if you can have them or buy them for cost/cheap lol

      If the insurer has already paid for the parts, you could speak to the insurance company and discretely let them know you're going to be asking the shop to provide you with the ordered parts. It's no further loss to the insurer and it's better that you have the parts than the shop. You could use those parts to fix up the wreck and sell it as a track bike.

        Just spoke to the insurance. They said I could keep the parts :) I hope the bodyshop actually has these parts they claimed to have ordered. For some reason I smell a rat here…

        • Yeah if you are looking to sell it there are definitely places you can get more for it than a wreckers. Especially if most of the damage is superficial.

        • @k-rokfm: Perhaps I should put it on gumtree/bikesales. Every extra $$ I could get for it could go towards a new bike. The two wreckers I spoke with are asking for peanuts. It is a 6 week old bike ridden only 400Kms.

    • No I can't re-register it. I would have to sell it to a wrecker for few hundred bucks I guess.

  • what did you pay the insurance company for it?

    • They deducted a couple of hundred dollars from the settlement. They themselves came up with the figure/offer and I took it.

    It's an interesting one, because the body shop only ordered the parts because the work was approved by the insurer, but I'm fairly sure the insurer will argue that they only gave approval because they were initially told that the bike was repairable - only to be told otherwise at a later point in time.

    I'm sure a google review for said dealership would help move things along… :)
