Employer Paid Wages to Wrong Account

Hi Ozbargainers, I was wondering if anyone has had this happen to them and if they have managed to get their wages back.

My daughters employer has been sending her pay into someone else's bank account that the Commonwealth has idenitified as active.

Her employer is saying that this was the account details that she gave them but they are nothing like her account details except that they are both Commonwealth Accounts.

Has anyone else had this experience and is there anyone who can help her to get her pay back? Any advice would be appreciated. Thanks

    Ask the employer.

send me ur bank details, date of birth, address , passwords and TFN and I will investigate for you

    or contact the employer….

ask them for the forms that you filled out, if its different I would talk to their manager, could be fraud (the person sent it to his own account1)

should be a record of somewhere of the details she has provided - either paper based or electronic on her file. Surely they can check this to see evaluate responsibility for the error? Can the employer contact CBA?

    • They’ve probably mixed up employees in the pay roll system.

She needs to send a polite email to HR and they should be able to fix it. Assuming she gave them the correct details she should be able to get backpaid.

Sounds like something the employer should sort out by contacting CBA

Only the account holder can authorise the funds to be returned to the remitter.

You use the plural of has been "sending" her pay….. so why didn't your daughter correct the situation on the first occurrence?

    • Only the account holder can authorise the funds to be returned to the remitter.

Pretty sure if it is deemed by CBA as fraud or clearly an error, they can make the call and send it back.

The problem is if the person has withdrawn it already…

She's a rich girl, and she's gone too far
Cause she know it don't matter anyway
She can rely on the old man's money

It's a bitch, girl, but it's gone too far

Can she prove what account details she provided to them? ie a email?

  • I've had this happen on several occasions. Employer sent salary to wrong account because he selected a saved payee when using mouse scroll, and hence it changed payee address. Managed to see it on CCTV.

Other times it was a system error.

It could be an innocent mistake.

    • nice cctv resolution .. picking up mouse scrolls

You can see the drop down menu as he checked (by clicking each box) and scrolling down as he did.

Needless to say, he wasn't tech savvy. Older gent.

does she have the forms she submitted to her employer.

    identify who is wrong here

if employer : there problem, they need to pay her wages and chase this up themsevles.
if your daughter : then her problem to chase the other account via the bank, but there is likely no recourse to get it back if the other person does not wish to be nice.

Out of interest, as you are asking on behalf of your daughter, is she younger? Retail or hospitality job? Do you know if she originally filled out on paper or electronically (which is possibly easier to adjust if someone is committing fraud).

When your daughter started employment she would have had to fill out a Bank deposit form. Ask the employer for a copy. Maybe your daughter is at fault? either way this form would clear it up.

    • Thanks everyone for your replies. The retail employer is trying to suggest she has given them. The wrong number but she had transferred stores so they said they would just use the same account. Update is that they are conducting a track and trace to get her money back i assume.
