eBay Purchase - Item Not Received - eBay Refused Refund - Yes Another One

So my situation is similar to most of the cases as mentioned before. I think my seller is a bit dodgy though, although they have great ratings on eBay. My negative rating has now been removed. There seems to be new negative reviews in this month for the seller, but if eBay removes them, the seller's rating will seems higher than it is.

  • 19 Jan Item Bought - Estimated delivery date 25 Jan via Courier, tracking number received via invoice.
  • 25 Jan follow up with seller, as the tracking info has not updated since then on the courier's site, no scan events since 19 Jan.
  • 6 Feb - After a few days of going back and forth between myself and the seller. He says that he will re-send the item, as according to him it was send, but nobody at the warehouse seems to have confirmation of this, "I should tell him if I end up with two"
  • 12 Feb - Follow up for new tracking number as he stated he re-sent it - no response
  • 13 Feb - Follow up again - no response
  • 19 Feb - Log dispute with ebay, as I have not received the item yet.
  • 20 Feb - Ebay refused refund as the tracking number shows as delivered (I never received this new tracking number from the seller), I now at least know it was re-sent with Auspost and what my new tracking number is. The tracking number indeed says delivered, although I did not receive it.
  • 20 Feb - Appeal decision of no refund. I have now logged the issue with Auspost, as the item was not delivered on the date specified although the tracking number says delivered. I work from home and was there at the alleged time it was delivered. I let eBay know I have lodged the issue with Aupost, with screenshot as proof, to my appeal case.
  • 21 Feb - They close the appeal as according to the eBay, 5 days have now passed in the Ebay universe, and according to them I have not provided any extra info.
  • 23 Feb - Go to Auspost branch, was told I should tell senders for signature on delivery…. !@#$ me, REALLY ! They can't do anything, I need to wait for Auspost investigation as "the parcel was delivered by a contractor"

I have now also lodged a claim to Paypal as I don't have any faith in a positive outcome from Auspost on where my item is. This is my first time dealing with such an issue with Auspost, so I dont't know what the usual outcome is.

I assume I'm !@#$ed in this instance? Do I just cut my losses?

    Did you pay PayPal through a credit card? You should be able to contact your bank and do a chargeback if so. Might be worth trying if you are on a debit card also as the bank may help you.

    Just be prepared to never use PayPal again as they do not like to have chargebacks and will put a strike on your account/details.

    • Nope, used a Mastercard Debit Card. I will wait for Paypal's response. I will then try and do the chargeback. If there are issues, I will just use another paypal account going forward.

      • Some or most mastercard/visa debit card also has chargeback option. Contact your bank.

        • OP - Paypal are your best bet. As Rashed/c0balt explained, it's highly likely that you will get a refund from the MasterCard chargeback service if Paypal fail you. Good luck!

  • OP, you did not purchase anything from Auspost, and the sender is actually the paying customer of Auspost in this case. Why do you expect Auspost to refund you?

      I have read my OP again, could you please point to where I said I claimed from Auspost?

        • I dunno, my apologies as English is not my native language, so the construction of my sentences could be off and could be interpreted incorrectly.

          I have lodged with Paypal direct, as Ebay refused to refund me. The reason I did, is because I doubt that Auspost will ring my up and say, aaaah, found it! So I need to find another way to get my money back.

          The last part was just in conclusion, as I have delivered 100s of packages with Auspost to my address, and have never had a situation where they say the item has been delivered when it has not. In dealing with them about this, it just seems they could not be bothered to help really, as it is my fault for not ordering something with signature on delivery. I don't get why the item was not returned to the Post Office for collection, it was a pretty large package.

      Both the sender and the addressee are Ap customers. The conditions for compensation is depended on the status of the mail article.

    Having gone through something like this recently (although I was the seller, not the buyer), I would suggest you ask AusPost to get the GPS co-ordinates from the contractor's scanner who did the 'delivery' to at least show they were somewhere near your delivery address to complete the 'delivery'.

    It also sounds like the contractor, if they did deliver it, did the infamous 'safe drop'.

    • Safe drop is fine in my place, and I wish it was used all the time instead of having to go to the PO.

      • I usually don't mind safe drop for myself, but I was sending to someone who lived in a block of units. I have no idea if the contractor even left it at the right unit, but suffice to say they never got it.

        In my case I had insurance and got refunded for most of the amount (minux excess and GST)

      • Safe Drop is great for the buyer provided they get their parcel. Terrible for the seller should the item disappear. I request NO SAFE DROP in large texta letters on outgoing parcels of value, and yet they STILL safe drop them. Australia Post need to become more accountable for the deliveries they are entrusted to make.

          These aren't valid delivery instructions. You must include the delivery instructions in the elad if you want the contractors for follow them.

      • I normally don't worry too much, as I work from home. My office looks out over the street, so there is no way to miss any deliveries. The once of twice I have actually been out when they deliver, they left a note to get the parcel from the PO. They have never used safe-drop.

        If this turns this turns out negatively for me, which I expect it will, I will add notes in all future purchases that signature is required and no safe drop. There are loads more for me to learn in Australia :)

  • Sometimes parcels do go astray.
    I had one marked 'delivered' to a neighbouring street by accident last year, and have received a parcel in error in the past.
    If you are lucky like me, the recipient will return it to the post office and it will get to you eventually.

    If it doesn't the seller can attempt a claim for compensation from Auspost, though that isn't guaranteed.
    In any case, it really makes your story much more confusing by including suggestions like the seller is dodgy etc.
    Just say "the parcel was marked delivered, but never received." as that is what you are claiming, not that the seller offered to resend, then didn't, then gave you a tracking number, that then said delivered.

    That is, I think that is what you are claiming. Or another reading is they sent two items and neither was delivered? It is very confusing trying to understand what happened, and what is your supposition.

    • I said the seller is dodgy, as I see more claims in past one with exactly the same scenario as mine. For some reason, eBay seems to close the disputes, which also then deletes the negative rating, as they did with mine. It seems that their rating should be a lot lower than it is.

      The initial invoice received stated a courier company with a tracking number which was never scanned or updated. Only after following up with the seller he agreed to re-send the item, as according to him, it left warehouse. The seller actually never gave me a new tracking number, I only saw the new number once I contacted eBay, as he only THEN updated the tracking number.

      So yeah, it is confusing, as I'm only putting down the facts as I have it. The seller has been unresponsive to all my messages and emails since 6 Feb.

  • If evidence shows the items as being delivered by AusPost then EBay, PayPal and your credit card provider will take this as proof of delivery. None of the aforementioned will give you a refund.

    • Yeah, this is why I ask if I should just cut my losses here.

      As I have not dealt with an item showing as delivered, which was not. So I don't know what type of questions to ask Auspost

  • Unless it was an expensive item just cut your losses as you don't have much(if anything) in your favour at the moment.
    Who was the courier company and the tracking number for the first shipment and what was the AusPost tracking number for the second shipment?

    The CP tracking number indicates it is only a valid transaction number. I would suggest that CP were never even notified of a pending shipment to be collected from the seller.

  • I am an ebay seller, AusPost misplace my items all the time. Tracking is a waste of time, couriers often forget to scan on collection or on delivery its a nightmare.
    I have had issues in a situation similar to what you have described, I then decided to use sendle and they were even worse taking over 3 weeks to deliver items, including 3 misplaced items. This was all in the space of only 1 month!

        Well I can get away with sending my items in a large letter envelope which costs $1.98 (I have a franking machine) to send BUT the downside is that I don't have tracking. In this instance I would get easily 10 cases of missing letters per-month which ebay would always find in the buyers favour. This was so frustrating as I knew in most cases it was a ploy by the buyers to take advantage of the ebay buyer protection, this went on for the first 12 months I was in business. I then got a stamp made up with a QR code, auspost logo and numbers to make buyers think the letters were tracked and the instances of "items not delivered" stopped overnight.

        Now I pay the extra $4 and send via parcel post which includes actual tracking although, I have had instances where the items say delivered but the buyer claims to have not received it. Upon checking often the delivery address provided was incorrect or different to the PayPal address or was left with a neighbour etc in only 1 out of thousands of cases had an item been scanned as delivered and I couldn't work out why the customer didn't receive.

        In the case where the item has simply been lost, auspost are useless and items are never recovered. Unless additional cover is purchased you are not reimbursed for your loss, there is a clause where by discretion they can reimburse you up to 50 dollars of the purchase price but this has never happened to me. Normally all I get is my postage costs refunded in the form of a money order, which sucks because I lose the value of my item, upset a customer, receive bad feedback and star ratings and have to resend the item so essentially not getting my postage price back anyway.

        It's so frustrating

    • We sell around 500 items per month on EBay and for parcels we use E-Go (online sub. of Hunter Express) when the recipient is in a capital city metro area. In 5 years we have only ever had one item that was lost - it was delivered to the wrong address. Always faster than AusPost as well.
