Moving to NBN Soon but Still under Contract on My ADSL2+

Current situation
I'm currently with Active Utilities (I believe they are using Optus), and I'm still under contract with their ADSL2+ connection until December this year. From the looks of it I will be getting NBN by end of march according to the NBN website (Hopefully this doesn't get moved, apartment and surrounding areas within the apartment already have NBN).

Question
If NBN becomes available, am I still obliged to use Active Utilities as my provider or am I able to choose a different provider? I've read some "horror stories" with Optus NBN so I'm inclined to switch to another provider (Aussie BB is an OZbargain fav so I might go with them).

I've gone through the contract and also attempted to call Active Utilities but I couldn't get a straight answer.

    Normally as long as your ISP can supply the service(ADSL) (ie area hasn't gone 18 months past RFS and Telstra are disconnecting exchanges etc, or some other reason it is no longer available) your still under contract, so if you cancel (or it is a service like FTTN where can't have both on same line) to sign up for NBN with another company you will be breaking the contract with them and you will be liable for the penalties.

    if they didn't cut your adsl2+ , means they're still able to provide you service as per contract

    you can downgrade to nbn with the same provider but pretty sure they'll tie you with a new contract, 'restart' XX-months again.

      Don't jump the gun.
      In addition to moving the rollout dates, over a million homes are now 'SC0', nbn has been rolled out to them (counted in government numbers), but there is no way for the house to connect.

      If you are lucky, you get changed to "more work to do" and "on average up to six months" for a year or two.

  • They are under no obligation to switch you over.

    You are under contract for ADSL2+, and that will continue to be available to you for the duration of your contract. Existing copper based services will continue to operate for some period after NBN becomes available. 2 years, maybe? You can get a date for your area from the NBN Co website.

    Your provider may let you out of your contract for ADSL2+, more than likely under the provision that you sign up to a new contract based on NBN through them, but no, you may not simply choose to take your business elsewhere while still under contract just because something better has come along.

    Sum: wait out your contract, pay a break fee, or swap to NBN with your current provider (assuming they allow this penalty free).

    While under contract you have to stay with them (or at least pay the monthly fees) even when NBN becomes active.

    You will find your contract will have a line saying something like when NBN becomes available, you'll have to move over to that with them.

    Of course, once your contract is up, you can change NBN providers to whoever.

  • I believe you have a warning notification before you are forced to change to NBN. Just wait for it or the end of your adsl2+ contract.
