Is Renting Always a Pain?

Hi Fellow Ozbarginers,

I moved in to a rental property in WA on 15/12/17 while we build our new house and still have not received a condition report of the property despite being promised it would be sent and other works are still outstanding. I emailed the agent on Thursday regarding the thing that are still not fixed which we was promised would be sorted long ago. Here is a list of problems:-

  1. Cleaning of dog excrement left by previous tenant and garden maintenance back and front due to non working retic. (this was noted by agent before 5/12/17 when I sent agreement)
  2. We had plumber come out to check water leaking though shower wall in to bed room on Monday 18/12/17 but we still don’t know from agent what’s going on with this and is it ok to use without causing further damage.
  3. Fly screens still not fixed. (this was noted by agent before 5/12/17 when I sent agreement)
  4. Toilet seat in master bed room is de-laminating and requires changing.
  5. Post box is locked and we can not get our mail out which was reported on Tuesday 19/12/17
  6. Kitchen extractor fan is vibrating so much that it is unusable.
  7. Still awaiting property condition report. (promised would be emailed on 15/12/17)

The property manager is a waste of space and time as I never get a response from her.

Is there anyway I can escalate the problems I have as I feel we have moved in to a house that is not fully worth the money we are paying. Can I ask for a reduction in rent until the works are completed?

  • I doubt you will hear from agent until the new year now.
    Is the letter box locked with a padlock or built in lock? If padlock then just cut it if no key has been provided.
    Kitchen fan prob needs a clean… easy to do.

    Agents are mostly worse than bad tenants and we had our share of them.

    Contact your local tenancy agency and be guided by them or read up your rights on their webpage.

    Finally settled into a new house myself, so i know the pain first hand. What i've found is that REAs are trying to find that balance between dividing the number of properties by the amount of time a staff member has, and going for a big brand doesnt actually mean you get quality.

    1. Bit of a shitty situation, just flick it into the garden.
    2. You've reported it, and they've done nothing, just use the shower.
      3, 4, 5 are non urgent issues.
      Six. Could be wrong, but do they even owe you a property condition report?

    btw, this should all be reported officially. Do they have a maintenance request form? have you emailed this in to reception with a read/delivery reciept? What happens after that isn't your problem.

    RE the letter box, you can probably jiggle it open with any key or a bread knife.

    In QLD its possible as a tenant to file an official Notice to remedy a breach to the Agent.
    In the event the breach of contract was not resolved in 7 days you are then in a position to issue a notice of intention to leave the property with 7 days notice.
    Potential a similar system exists in WA?
    As mentioned, a call to tenancy WA may be your best option at this point

    PS. In QLD the govening body suggests in the event the agent fails to complete a move in condition report that a tenant protects them selves by completing one suplemented with time stamped images.

  • Wrong time of year for tradies. Gets very busy before Christmas then they all go on a break so you might need to wait a bit. The wheels of the real estate agent can move slowly, but get back into them after new year, and tell them you’ll be arranging a locksmith for the mailbox unlesss they can get you one by the 28th Dec.
