BMW delivered wrong car and offered $700 + accessories

I have purchased 2017 BMW X1 back in October
It was finally delivered after 2 and half month

I was excited to take the delivery and went home
Up on arrival I found out that it was missing two critical standard features

  1. Dual Climate Control
  2. Sliding back seat

Now the sliding back seat is such a deal breaker
Since you lose about 3cm of leg room and extra recline angle

So I contacted the dealership and long story short

They built the car wrong and offered me $700 dollars
Because they are $700 dollar option according to them
And $1000 dollars worth of accessories lol

What should I do?
They want me to put up with it basically

Updates:
After some kicking and screaming at BMW Australia
Dealership Principal has finally noticed my case
And is working on solution

I will not accept anything less then what I ordered for

Updates:
Rear vent is missing as well lol

So total missing Standard features are 4 in total:
-Rear air vent
-Dual zone climate control
-Rear seat sliding fore aft
-Auto rear seat fold down feature.

Why would you order a BMW X1 in the first place? It's probably a front wheel drive model too.

    • +2

Op must be working for westpac too

  • -6

Why on earth buy a BMW?

GEt a reliable Japanese car. duhhh

Anyway, the law is on your side. YOur item wasn't as described. Back to the pavilion it goes.

      • -5

You would think that after one Outlander you would realize that they are crap!!! I know Toyotas are one of the more expensive Japanese cars but there is a reason for that… they last and last and last, they are the Japanese Mercedes, well built and long lived," should have bought a Toyota"
Yes you guessed it I am a Toyota owner and the one I own now, only my third Toyota in 40 years of motoring is the oldest car I have ever owned and I aim it will be the last internal combustion engine car that I own. I am aiming to get 1 million kilometers out of it (it is a diesel!) 30% of the way there!
Jeez Toyota should be paying me☺

Yeah, Germans don't know anything about making cars.

      • +3

The reasons people are having issues "discussing" the X1 are not solely related to it's build quality.

The cost of spare parts for German cars in 'Australia' is insulting.

In a normal auto forum I'm sure that no-one would have any issues "discussing" an BMW's or any German makes for that matter.

But here on Oz"Bargain" the concept of even entertaining X1 does go against one of the biggest fundamentals of the forum "affordability"

This is probably why there are so many negative comments in regards to German makes on this forum.

I myself for example wouldn't by one, chiefly for that reason alone.

they are contracted to supply you what you paid for.

This is their problem that they build by option but you are supposed to go through all of this with the dealer on pick up and they check off each item with you so the process has broken down somewhere.

If you were snarky and burn't some bridges because you were waiting so long they might be inclined to make it difficult.

You will find the major issue is the AC and they are trying to get off lightly.

Sorry don't know how long you had it before you noticed but i'd be taking it back to them and requesting that they give you the car you bought under contract and don't shift on that position.

All those overpriced extras are worth next to nothing when you sell it, even if that was tomorrow.

Yeah My wife has an older Volvo with dual zone climate control and it is"fully sic"
Some days my wife wants the heater and I don't so it does the job without opening windows.
So my vote goes with don't accept it, get the car you want and now it will be a 'year' younger!

      • I hear you there same happens in our car i want arctic conditions compared to my wife lol

    • +20

That's the worst reply I've heard. They are contractually obliged to supply what he signed for. This deserves an offer of him keeping supplied car until his as AGREED upon car is delivered.

From a current salesperson here, no he hasn't waived anything. Dealer breached contract, have fun if that went to court. Not to mention the bad publicity, reviews and social media which can bring a business to its knees.

Dealership fked up, and probably realised before the car left the showroom too, and just hoped to come up with a quick fix, which isn't working in this case

        • +4

          ex-car salesman here…

Can confirm, same opinion as Spack, dealer messed up, ordered wrong or were just trying to move a stock vehicle and hoped that OP would just cop it.

And it is exactly the same as a t-shirt. If I ordered a t-shirt with fluffy cuffs and it had none, I take it back for a replacement for the correct shirt.

I have worked in automotive sales before, so speaking from experience.

Would you be so kind as to letting us know where you work so we can avoid like the plague?

      • No, they'd look to delicense the car asap and put him in a proper demo.

  • +3

I have no idea about the law for it or anything, but seems pretty open and shut, they gave you a car that wasn't fit (or didn't have the features) that you paid for. They asked if you were willing to settle for $700+accessories, if you are not, tell them no and to either get you the car you paid for (or I guess a refund?).

    Good luck!

    Miaow.

    Thank you all
I will hit them hard tomorrow and if they don’t budge

    Then it’s

    Whirlpool
    BMW Australia

Do not take delivery of the car. Ask them to order the car you paid for and ask for a loan car in the meantime as they have wasted months of your time.
If they refuse demand a refund and purchase from another dealer.

    • +2

Unfortunately I have only realised the missing features after taking the delivery

But to my defence it’s impossible to check every features of modern car during the delivery process due to shear number of functions

Especially if they were states as standard features
I was only checking the options I ticked

      • So they didn't offer you the $700 + accessories until after you manually looked for the missing features in the car and noticed they weren't there?

        • Yeah
          Had to call around

      • Especially if they were states as standard features
I was only checking the options I ticked

Are those features part of a model update? Were they mentioned when you first ordered the car?

I can't see anywhere that mentions an X1 without dual-zone climate, both 2017 models list it on Redbook. What's the build date on your car?

        • Base interiors on all X1's in current model if they have changed it they haven't updated their website material. there was also no mention of anything being removed for 2018 range

It's been like this since 2016 / something seems odd for them to be missing (was the car hijacked from the production line that was actually going to another market country)?

try get ur money back and wait 2 months, you will get a 2018 model.

  • +9

Germans dont build the car wrong. Either the dealership ordered the car wrong, or the car is stock they are trying to clear out and do a shifty.

    • +2

Yep. More than likely old stock or failed previous order. Give it to a customer and throw money at them in the hope that they just take it…

    • +1

Germans aren't building them. X1's are built in the US and Netherlands a lot of others from BMW we get come from China

Reason i know they pull things off production line was they did it for me, i've seen them over look things when something goes wrong in a flap.

My car was dropped off the wharf written off rather than try and be dodgy they got the first car that was a dealer order and it was slightly different spec but they didn't notice till it arrived

In my case i got some things i didn't order like the premium sports seats in the front and missed out on one option i had picked which was low value.

That and they gave me a brand new basic entry level model model of the car to drive for the 2 months it took to get the new car here.

  • +6

That's a horrible service. I work in Mercedes Benz dealership and unfortunately this has happened to us as well. We would always offer some kind of compensation or the correct car and it's up to customer to choose what's more suitable. If car is ordered correctly they would make it a priority to make a new one and ship it to us ASAP. I'm afraid there was a mistake on the other end and your dealership (profanity) up that's why they trying to fix it this way. Get the car you asked for!

    • +1

I should have worked harder and get the GLC instead!

  • +1

I’d be asking for $10k compensation. You might want to get a quote on how much to add these features to factory spec. Hit them with that amount as a demand plus some! Consumer law is all on your side I think.

    • +1

no chance they would give 10k compensation. That's absolute nonsense. Why would they do that if taking the car back and deliver the correct one would cost them close to nothing?

    • +1

Even if they offered me 10k
      I would not accept it

      I want what I ordered.

      • +2

        I want my elephant!!

      • +1

        Whats the latest update? Cheers

Dealership principal is trying to get the new
          Car built for me apparently
He told me he is waiting for the response
          From the Germany HQ

          Could be all BS
This will be the last week before I go ahead with ACCC

What a shameful and undignified mess this is from
          Supposedly premium brand
