Optus Cancellation Fee for Broadband Bundle - Switching to NBN

Long story short, NBN is here and ADSL2+ would be disconnected but i still have a long 19 months contract with Optus.

Online chat with Optus, they say I will have to get a whole new 24 month 12mpbs NBN plan for 60/month…which would be slower than my current connection speed.

I do not think it is fair to get a lower speed when I need to pay the same money.
Then I asked Optus (via online chat)

  • Whether they can boost it for free to match my old connection speed….

    No.,they won't. I have to pay extra $20/month.

  • Whether i can get out of the contract as they would not be able to provide the same service with no cancellation fee….

    No, they won't. And I have to pay $390 cancellation fee.

  • Whether they can shorten the term or at least just let my current plan term continue, instead of getting a whole new 24 month to reduce the suffer….

    No, they won't.

Anyone in a similar situation?

    EDIT: wait, you still got 18months from NBN became available before adsl cut off

    • I will do so if TIO can't get me a better solution… Just don't know what to do after the line is cut off. According to the optus guy, I will have to keep paying the bill for nothing.

    • It is a bad idea..when I sign up, they say it's nbn ready one. And I didn't realize the speed would be reduced…

      • adsl2+ speed is anywhere between 0 mbps to 25mbps

        but you're right , mainstream telcos price NBN for 12mbps at $60 which often slower than adsl2+ who lives closeby to exchange.

        ohh, more 'good' news, nbnco looking to raise the cost of slower speed cat. to push telcos to promote ppl taking up higher speed packs for profitability.

        • Even optus comes back with a better speed, I probably would still just wait till the current contact ends. Had too much with them resently.

          Charging me $300 for returning their shit box late(which was returned as credit after proving them it was sent and it was their fault);4 days to change a mobile plan….

    If they can't supply what you contracted to purchase then they are breaking the agreement.

      adsl2+ contract is best case basis

      theoretical 25mbps

      some ppl get less than 1mbps

      some get 20 mbps

      depends on distance to exchange & copper quality

    Just stay on ADSL as long as you can, why swap to NBN. There is a 12 months (?) grace period before the old telephone lines are disconnected.

  • In my experience dealing with Telstra, (I assume Optus is the same) the online chat is pretty useless and they always just stick to the script.
    Over the phone they were a bit more lenient in waiving fees and giving bonuses.

    Just for clarification it's actually a max speed of 11mbps with a typical speed of 9mbps during peak periods….

    Unless you have a copy of your contract saying "When the NBN arrives you will get the same speed for the same price" the TIO can't do anything. If you have gone to the TIO for anything else you will get a sorry we can't help you. Because the OP says Optus haven't done anything wrong.

    No matter how unfair you think it is because you still signed/agreed to the ADSL2+ contract.
    As long as Optus keeps their end of the deal in supplying the contracted service. There is nothing you can do to get out of it. Optus don't need to shorten it or wave it if they don't want to. They could if they want to keep you as a happy customer but not legally required to.

    You might get better luck with speed boost discounts etc if you wait a few months. Because if you are on a Optus DSLAM as they will get their disconnection payment sooner if everyone is off it. :)

    If Optus cannot continue to supply the ADSL2+ contract to termination, and will not offer a service with the same maximum speed for contract duration, I would simply let them see it to disconnection, and then dispute any "termination fee".

    Irrespective of what the contract says, the ACCC will take them to task if they dare try to charge termination fees when they are the ones unable to continue supply on the same terms.

  • Stay with adsl. You have 18 months after the area is NBN to switch over.
