eBay Seller Promises Mutually Agreed (by eBay Messaging) Partial Refund if I Withdraw eBay Case. Proceed?

So, this eBay seller agrees to a partial refund on a Samsung Note4.
That is; once I close the eBay case on the matter.

The item was listed Genuine Unopened box…etc. Paid $305
The charger was fake (no dual voltage), Box was dodgy (and seemed pre-opened)
The phone itself seems genuine (but small scratches near USB port, a small gap between back cover and body when closed etc.)

I opened an eBay case; now running return period.
In the interim, seller agrees to refund $60.
But he wants me to close the eBay case first.
Records- snippets of the discussion- exist on eBay messaging.

Do you guys think it's legit to accede?
Would eBay protect me if I close the case and then the seller doesn't refund?
Anyone has similar experiences?

    Return item and full refund. Seems suss to me that they are agreeing to give you half the money back.
    If it fake, stolen or used then you've lost half your money.

    Once closed nothing you can do.

    Absolutely not.

    I believe they should be able to offer you a partial refund through the eBay dispute system. They will have a timeframe to resolve the issue and if not, you can ask eBay to intervene. OR they can definitely offer you a partial refund through the PayPal case system. I would contact eBay first then PayPal to check how they recommend proceeding.

    Make sure you keep using eBay messages to interact, at least that way you'll have a record.

    Personally I would be sending it back for a full refund, sounds like it is already damaged so probably a dodgy refurb at best.

    Cannot close the case, you need to hold on to something otherwise they will run away.

    There was once I accidentally left feedback to an item that I just purchased, the seller ended up did not even bother sending the item. Holding on to the dispute case is as important as holding the option to leave a positive feedback… Never let it go until you have received your intended item/refund

    I'm definitely going against what every one else says, and I'll probably get a lot of negs for it but I stand by my advice - "do NOT close the case, it is the only thing that is protecting you"

      "Going against every one else" generally means you are in disagreeance, not agreeance.

    Full refund and nothing else, not a partial, not a close!!!!!!!!!!!!!!!!!!!!!!

    Seller has already proven untrustworthy, don't let desire for the item override common sense.

    Stand your ground, if you accept paying $240 for a second hand phone then it's your choice but as the seller is demanding you close the eBay dispute first I'd probably get the full refund, through Ebay, seller sounds dodgy, demanding and difficult. The gap in the back cover is a concern, scratches are scratches but dodgy repair might come back and bite.

    Be aware that i you dont accept it and its raised to a dispute you may get nothing from Paypal or Paypal may require you to return the item for a full refund. I had a situation mid year where i ordered an pair of 3d glasses from China that failed to identify that the item was not compatible with all Epson projectors, just a few. Anyway i lodged a claim and they offered half refund if i close the dispute but they would only do so if i close it first. I did not agree and it was escalated. Paypal did find in favour of myself but i was required to send the item back. Unfortunately the cost of shipping was more than the cost of the item so would have been pointless. in the end i had to let it go and i got nothing. So just be aware of this situation.

  • Eh I've closed the case on request before for smaller products and they refunded me after.

    Why would you agree to that? Take the ebay case to conclusion, get your full refund.

    The seller has already proven themselves to be dodgy once, why would you give them the chance to be dodgy again?
