Parking Fine - Incorrect Offence on Ticket

Basically I parked my car in a car park, without realising they had installed ticket machines since I've last parked there - so I didn't realise to get one (irrelevant but I knew it used to have a 3h limit, now it's first 3h free but you need a ticket). When I returned to my car, there was a ticket issued with the offence 83588 'Stop in restricted parking area'.

Having looked it up online, I don't believe I have committed that offence - I parked in a regular parking bay, within the boundaries, and there were no markings or signage to indicate that it's a restricted parking area.

  1. Wouldn't the correct offence be something more like 'failure to display valid ticket'?
  2. Does the ticket still stand if it's got the incorrect offence listed?
    • I have requested a review, with photos showing my car not in a restricted parking area. I received a response, saying the fine stands however their reason was some generic copy/paste and didn't actually address the offence they've booked me for.

Thankfully I can pay the fine if I need but was wondering if there's any chance I'm able to get away with it due to their mistake?

If anyone knows anything or has had experience with something like this, your help is greatly appreciated!!

    Well you did stop in a restricted parking area by not having a valid ticket. You can contest either if you did have a valid parking ticket. so don't see the point contesting it since you clearly don't.

  • First you need to determine if you where issued a parking infringment notice or a request for liquidated damages. Who issued the 'fine'?

    • Follow the money instead.

      Who are you suppose to send the money to? All government fines go to the SDRO. Private operator 'breach of contract' payments won't.

    (b) an end restricted parking area sign on each road out of the area.

    Why can't people just accept responsibility for their actions these days. The fine would possibly be waived and re-issued with the correct infringement code and penalty that applies.

      Op, please note this as stated above . If the offense has been committed, it is complete regardless if the fine code is incorrect.

      Assume you got a speeding ticket and the officer wrote the wrong code on it and you brought it to their attention, all that would happen is , the original would be withdrawn and a correct one written out to you and a letter telling what happened!!!

      Believe me because I've been a local laws officer and a cop!

    Is there a sign that says "3P TICKET"?

    In that case it is technically a restricted area. It has a 3H limit meaning it is restricting you to 3 hours of parking.

    Someone above has done the hard yard and googled it for you so I won't repeat them… I do think that car parks that make you get a ticket to park for free is a waste of paper and time and effort.

    What mistake? They issued the correct ticket.

    I wouldn't have written in before posting on here. I'd have written in explaining at the date I was last at the shopping centre. Something like "I did not need a ticket(hopefully this was within the last 6 months). This was changed recently and therefore was wondering if there was any chance the ticket could be waived on this occasion. I do understand that it is my responsibility to check the restrictions and will be more cautious in the future.

    If the car park is badly signed I think you could appeal it again but if you just weren't paying attention that day there's no point wasting your time.

      Shopping centres don't.

      They don't want you to park there all day (eg commuters) so other people can and spend their hard earned cash on whatever crap the shops are flogging.

      The ticket just makes enforcement easier - no ticket = fine.

    Sounds like a private car park 'fine'. If So, ignore it and it will go away, despite their numerous threats of court action.

      Councils also have a contract with car parks to enforce restrictions… find out who issued the ticket !

      • It really doesn't take much to figure out who issued the ticket. Obviously my advice was based with that knowledge in mind. My own experience relates to 'Care' private car parking of which I received a ticket and promptly ignored their replies over a 2 year period by which time they stopped coming.

  • OMG. What a load of BS! You parked in a parking area without obtaining a ticket. You admitted this. Just pay the fine and leave us alone. This is a total waste of OBs time.
