Reversing Accident Advice Please

Looking for advice.

I was reversing out of a 45 degree roadside angle park. Looking over my left shoulder, the road was completely clear of traffic. Before I even got parallel with the kerb I was collected by a 4wd scraping along the back of my car. The 4wd was coming from the opposite direction and turning right into a driveway near where I was parked. The driver admitted he accelerated to try and get around me but says as I was reversing I am 100% at fault. I say he turned into the path of a moving vehicle.

Any thoughts? I am absolutely denying fault so it seems this is going to get messy.

    Insurance companies say dont admit fault.
    And just let your insurance do the rest, dont stress, thats what you pay them for.

    Normally as the reversing car you would be 100% at fault…

    • From my experience, one driver in a two car collision is rarely held to be 100% at fault, unless one vehicle is stationary.

  • A bit hard to understand the situation without a diagram, however I don't think it's as simple as 'You were reversing, hence your fault'. If I understand correctly, he turned across the lane you were reversing into? If he was entering / crossing your lane, he should also be giving way. In any case, the previous "Let your insurance company sort it out" is the best advice!

    Usually reversing cars are at fault, but the 4WD being from the opposite lane, should, I believe, give way to all cars on the lane he's entering/crossing. Another one of those grey areas, best to let your insurance figure it out- don't forget to report back!
    Even if the 4WD is not at fault, it's very stupid of him.

    • too often though, especially at shopping centre carparks, people think that because they're reversing out of their spot, they have right of way

  • you were in your lane, he was in the opposite lane. The crashed occurred in your lane….I'm gonna say you're safe, but let the insurance company do it's thing. Please update this though!

    What is with all the ozbargainers making threads about automobile mishaps they were very responsible for then complaining.

    • So you can't reverse out of an angle park if there's traffic coming in either direction?
