Booked Hotel Room With Spa in USA via lastminute.com.au - Was Given Room Without Spa

Recently I was on holidays in USA. My wife and I booked a spa room through lastminute.com.au (Expedia owned) and when we arrived at the hotel I was told we did not spend enough and the was a $50 USD surcharge.

After some discussion it had come out the Expedia had been booking the suite and the hotel had been putting people in non spa suites. Despite the fact, I booked over the phone and have written confirmation that the Hotel had confirmed the spa room, they had on sold the room and the hotel said I needed to contact Expedia.

So this ended up taking 3 hours (getting through to last-minute through FB page and I trying to call and waiting for them to call hotel)) and, in a normal room despite the fact, I said if they could not provide the room I booked I was happy to travel to another hotel for a similar grade of room I booked. So I spoke to the manager the next day and she just said we were put in the room we paid for.

So now I am dealing with last minute and they have just offered me a refund and $100 credit but this seems unreasonably low, due to the fact I feel that the behaviour was fraudulent.

So does anyone know what legally I am entitled to?

    Wait, you're being offered a full refund for the hotel stay, plus $100 credit, and that's not enough?!

    Cmon…

    Let Expedia etc deal with the hotel (who won't be getting off lightly via Expedia) and enjoy the fact you're walking away with a free stay.

    To be honest I don't quite know what would be satisfactory. I am very upset about how I was treated by the hotel. That is why I wonder what exactly is reasonable in this situation under my consumer rights or do they not even apply as the hotel was in America

      Expedia/lastminute.com shouldn't be the ones to cop the heat, yet it sounds like you're giving them hassles because of it

      They're giving you a refund, let them go toe-to-toe with the hotel. They wouldn't cop a full refund lightly.

      All I can say is I really hope you didn't let the lack of a spa sour your overseas holiday, but I think I know the answer to that one considering you're still fuming over it.

      • The problem was that was the night we were treating our selves getting a suite before we flew home. I get crap happens but this is fraud to me and the hotel seemed to blame Expedia like this had been going on for a while

        • So who's word do you believe? The hotel, who would rather you paid higher prices, or Expedia, who advertise at prices that are worked out with the hotel?

          Again, you really think Expedia are fully to blame? The hotel doesn't exactly like selling rooms for fk all through Expedia.

          Fraud- wrongful or criminal deception intended to result in financial or personal gain.

          So you got a refund and a $100 credit, so where in this whole story has expedia gained anything?

          This is called overbooking, it happens all the time in the hotel/airline industry. You didn't get what you paid for, you got another room instead and got a refund plus a credit. It would've been fraud had you turned up to the hotel, the hotel had no record of your booking and you had to pay for a new room and Expedia refused to give you your money back.

    So, it appears that:
    You booked a room with a spa,
    The hotel did not have one, so you had to shower,
    Because of this, you stayed free and score a $100 credit, and
    Two weeks later, you are telling a group of strangers how upset you are.

    You came out ahead and are sooking about it?

    Legally nothing. You have been compensated. I'm sorry that you received a nasty surprise but thats about it. The rest you've done to yourself.

  • I think OP is mad that they feel they were screwed over. That this wasn't something unforeseen eg. spa broke but rather dishonest behaviour by one of the other parties eg. overbooking.

    They want a penalty to discourage the shady behaviour they feel happened in my opinion.

    Jesus (profanity) wept… A refund and $100 credit? That's more than fair… Spoiler alert: if this incident ruined your holiday, your holiday wasn't going all that flash to start with.

    Why not focus on enjoyable aspects of the trip, bummer that the last night was a bit of a hiccup, but that's travelling.

    Get over it, you had a free nights accomodation, most people would figure the issue was resolved.

  • Simple. You are entitled to the difference in room charges and nothing more. Nobody knows who stuffed up. Could be lastminute, could be the wholesaler (expedia), could be the hotel. But who to blame?
    Considering you are getting a FULL refund PLUS $100 just stop complaining and take it! Just like the first poster and many others have said. OMG. Get over it. Amazing what some people expect for a one time casual booking.

    PS Let me give you a huge hint: DONT EVER BOOK WITH booking.com because they would have given you NOTHING!
