Building Retaining Wall in Easement

Hi all,

I was hoping to get some advice on building a retaining wall in an easement. Our current landscape plans have this positioned in it but towards the right hand side. Ideally we'd like to cut the block to the boundary and build the retaining wall as close to there as possible. Has anyone been in the same position? Approvals wise does this just sit with Sydney Water?

Any advice would be great I've been researching but am now to the point of utter confusion on what i can/cant do and what approvals i need to get

    Seems like you've engaged professional consultants. I would recommend chasing up the landscape consultant which would liaise with the town planner. The town planner will then make the call or liaise with Sydney Water and get an approval.

    Sydney Water will own that easement and in the scenario that they are required to upgrade/repair their infrastructure, they're allowed to rip everything up and it doesn't impact on the building structurally.

  • We bought a property that had an existing garage over the easement (more a fibro shed) - we understood that it could be torn down if they needed access. I would be talking to council and getting the official line on this. Personally, I wouldn't be putting anything structural on an easement.

  • I would ask council before building it. We built one a while ago & it all depends on how high the wall is? how close it is to the easement? judging by the photo, the wall seems pretty close to the fence. Now depending on the height & distance to the fence & your council. You may need approval from neighbour.

    This is going from my person experience. Your situation may be different if you don't need a tall one.

  • While you will have to deal with SW I would expect that you wouldn't be able to build anything permanent on the easement which might interfere with access.

  • Aren't easements established to stop people building on the location of the easement?

  • Talk to Council and Sydney Water. This is purely situational, because Easements are for the use of services on your block and also the surrounding blocks. Council will pretty much say it depends on what is there or going to be there.

  • Ahh thanks all for the input really appreciated. The retaining wall is going to be no higher than 1m. I've had a few contractors in and a few have suggested besser blocks so in the case they do need to take anything down we can just pull it apart. The landscape plan is confusing me because technically it is still sitting in there…! I'll query council again.. last time i spoke to them they said approval wasnt needed for walls < 1m. Thanks again guys
