Do i need a solicitor for purchasing OTP

Hi All,

I have purchased an OTP apartment 2 year ago, do i need a solicitor to complete the purchase or could i diy myself.

The reason why i have the concerns i might need a solicitor was because according to the new plan of subdivision document it seems like many of the storage cages ( including my apartment ) were removed without any notification.

My first thought was could it be an error made by the developer, however after trying to contact the sale consultant from the agency which i have purchased from, the sale consultant said he was unable to assist and kept referring to me to contact my solicitor.

Hence this has prompted my question.

    • I've personally used Arthus J Dines & Co before. Off the top of my head we paid about $6-700 for an existing property purchase and we were very happy that they covered off on everything.

      In saying that, as Doz pointed out, it seems like you know the answer. Perhaps they are hoping a solicitor will recognise that your contract possibly allows for this and would therefore be a bit more level headed than telling the buyer that they aren't getting their storage cage (I know I hate disappointing customers, especially where they may react irrationally).

    You should have already had one to look at it before you signed the contract, Late is better than never. Ask a friend/relo who has purchased one in the past in your local area that they were happy with.

    I am not sure the about conveyancing in VIC, but in NSW, most of the Off the plan contracts would include a special condition about the draft strata plan and registered strata plan. That is being, if there is any deviation (more than 5% in total square metres) between draft and registered strata plan, the purchaser is entitled the rescind the contract with deposit 100% fully refunded.

    I would suggest to look at the special conditions in your contract if you are entitled to your rights.

    • Very similar in Qld. Would be most surprised if Vic was not the same.

      It may not be in special conditions though. It may be a statutory right.
