Speeding Fine In School Zone - Submitting A Review (NSW)

Hi everyone,

Just want to get some comments about submitting a penalty review based on the reason that I have a 10 year clean record, no demerit points.

I was fined for driving 54km/h in a 40km school zone.

My question is what are the chances of OSR accepting this?

  • Can't hurt if you try. Worst case scenario the answer is no. I have heard anecdotally that school zone offence waivers won't be entertained though, only regular demeritable fines.

    They won't on principle because it's a school zone and you're endangering innocent children. Most speeding fines are just revenue raising but speed limits in school zones exist for good reason.

          I say we get rid of the school zone speed limits… Little bastards wanna cross the road, let them run the risk… Back in my day, we didn't have speed limit restrictions at our school and one of our class rooms was ACROSS THE BLOODY ROAD.

          Do what ever speed you like and let god sort 'em out.

    You can't get off on a school zone infringement using the 10 year good behaviour clause.

    From the SDRO page. We cannot consider a clear driving record for parking, non-demerit or serious traffic offences, such as a school zone offence, speeding more than 30 km/h over the limit or driving while using a mobile phone.

    • what isnt covered in that list? it looks like its just non-serious demerit offences. but non-demerit offences are excluded regardless of severity?

      so maybe they figure that demerits are a serious punishment, so measures are put in place to make sure they are dealt out fairly. but other punishments, such as the typical excessive fines, dont require such careful handling and so they dont worry about checks and balances. so if you get a fine without demerits, tough shit its only money, pay up sucker

      it means that you could park somewhere, get delayed and overstay by one minute and rack up a parking ticket ($108), then have to rush somewhere else because youre late and get a speeding ticket for driving up to 10km over the limit ($114). and youd only be able to contest the speeding ticket because it has a single demerit attached to it. the parking ticket has no such leniency for that one minute

      if you happened to park in an offpeak clearway and were too late to move it, that parking fine would be $253. i think id prefer the demerit+smaller fine
      or you could balance it out by speeding up to 20km for $265, and then theyd probably be even more lenient because theres 3 demerits which they are so careful about handing out.
      its like, speeding kills, but we understand people can make mistakes. but dont even think of parking in the wrong place or we'll hurt you

      the problem is how nonchalantly they hand out excessive fines for minor offences. it makes some sense to have a lower threshold for punishment before considering leniency. but over $100 for parking is absurd and far from being a trivial punishment where the option of leniency should be neglected. and as long as it doesnt have a demerit, it could go up much more

      dude I got fined at Beverly Hills, NSW right restaurant strip, no schools along that strip don't even know why it's classified school zone, more like an eating zone.

        The school is up the road from there maybe like a few hundred meters away and kids are always crossing around the shops!

    I'm glad you got fined for doing 54 in a school zone. I am sick and tired of all the idiots speeding around our school

  • My wife got caught doing 51 in a 40 school zone about a month ago. She tried the 10 year clean record review option but they rejected it saying it was in a school zone so it wasn't sufficient. I personally think that's a fair call.
