Lightinthebox - 8 Weeks to Ship Even Though I Paid Express

Hoping I can get some help from the ozbargain community for this.

I bought a Xiaomi Notebook Air from these guys on the 30th of March (https://www.ozbargain.com.au/node/298850), three weeks ago now, and it was only shipped yesterday. Sent in a ticket and was told that they had accidentally sent it via regular post and to contact them if it doesn't arrive by 28th of May, 5 weeks for now.

The laptop would have been incredibly handy to have since I'm doing some project work in remote areas but it isn't 100% necessary.

They've offered me 15% of the purchase price as a voucher but the conditions are that you have to spend double the vouchers value to be able to use it which I don't think is great compensation.

At this stage I think my best bet is just to cancel and buy through aliexpress but since the laptop has already shipped how can I cancel it? Can I open (and win) a PayPal dispute? Would I be able to refuse delivery of the laptop once it gets here considering its sent via untracked post?

What would you guys do?

  • You could try Significantly Not As Described - you ordered for a specific project on X date (say 5 weeks in, to be generous for shipping) and paid extra for it. What they supplied you does not meed your needs.

    Can only try, I guess. Then when it comes, just refuse delivery.

    • That's true. But is slow shipping enough to qualify as "significantly not as described"?

      Your order was shipped out via PostNL-untrack on 2017-04-20. The reference number is PNLxxxxxxx. This number is merely a serial number which cannot be used to track your package online. Our most economical shipping method does not support tracking services.

      I didn't believe it myself…which is why initially sent the ticket.

  • If it is untracked you will win a paypal decision since Lightinthebox cannot prove that it's ever ended up in your hands or at your paypal address

    Open a paypal dispute.

    • I understand that, but wouldn't that be relevant only for opening a dispute based on item not received? Presumably it will get here, just very late.

      • Yes, but the fact it has still not arrived & they have dicked you around with a worthless voucher means I'd be concerned the item would never show up. It'll be 8 weeks until it 'maybe' gets to you via an untracked postage. It's not your fault it hasnt shown up.

        They cannot prove the item has shown up or is even enroute since they shipped it without tracking, paypal will either get lightinthebox thinking about giving you a proper discount or they will risk losing the entire value of the sale due to their incompetence.
