Bumped into car in car park. My fault.

Hi,

I bumped into a car in a car park. It was my fault. Blind spot.

Never the less. My error. Small scuff in their bumper, and even smaller scuff on my car. I apologised and ensured they were ok. Reversing speed was 1kmph.

We exchanged details and I got their car repaired via mobile bumper repairer. Their work is guaranteed.

Months have passed and I thought it was all good, but I now get a letter from their insurance company. Wishing to make a claim against my insurance policy.

As I have already undertaken repairs to their vehicle, is this correct for them to make a claim now?

Thanks

  • what are they claiming?

if the repair was done by a mobile repairer, and the repair is not up to scratch (no pun intended), then tell the repairer and let them sort it out

only you can claim against your policy

    • Their insurance company company has issued a letter advising they wish to make a claim.

No mention of the value or detail of the repair, however I wouldn't expect that at this point.

Just wondering if I'm better speaking to the insurance company or contacting the other party and clarifying what they feel is outstanding.

ignore it until they actually ask for something

        DO NOTHING until that point

you should also kept receipt for the repair and use this to ensure the other party is not trying to get you to fix something else

Because of people like you I bought a dashcam

I have a dash cam! That's why I'm not disputing it's my fault.

But I did take the right steps to correct the damage.

OP wasnt directed towards you. Was directed towards Outlander

I hope its hidden because the first thing people like me would do is look for a dashcam, but I digress. You misunderstand the context, OP made a mistake and has already payed for it. Now the other party is engaging in extortion, trying to extract more money from him. In such circumstances, what do you think is fair?

        • By going through the insurance company the party won't get any money. So how is it extortion?

they may have had a second accident and now claiming against you.
get your mobile repairer on side.

      Good point!

      I'll check it out.

  • Do you have any confirmation of the fix from the owner of the other car? Text or email? Alternately, as mentioned by others provide the receipt. I don't think they should be lodging it as a claim against you unless they were not satisfied with the fix.

I have a text from the owner confirming the scuff is rectified.

The mobile repairer also took a photo showing the work completed.

The other party is seeking a couple hundred dollars to adjust the bar a couple of mm.

However the photo from the Bumper Repairer looks fine.

I'm stumped that they would lodge a claim post repair for what is probably an indescriminent adjustment that they claim is a couple of hundred dollars to fix.

        Send it to their insurance

          Thanks,

I have put together a nice litttle letter with photos. Before and after pics including Dates of repair.

Did you have them confirm that the matter was concluded and finally settled?
In any event, I'd tell the insurance company that you cannot respond without knowing the details of the claim.
