Who Would Have Potentially Been at Fault Had This Become an Accident?

Hi guys,

This almost happened this morning on the way to work (Alexandria, NSW). I believe it very easily could have been an accident, had I been in a bit of a rush to get to work and not seen the cyclist out of the corner of my eye.

From the footage, it appears quite clear that he ran his light.
Would he be at fault 100%?

    the cyclist for sure..they are absolute twats on Sydney roads..ive nearly been cleaned up by these muppets multiple times crossing the road

      Get over yourself. There are absolute twats in plenty of cars and on foot too. I've nearly been cleaned up by cars plenty of times and nearly cleaned up stupid pedestrians who step out without looking while riding too.

    The cyclist was travelling quite slowly having taken off after the red and was also looking for traffic. Chance of a collision was low, doesn't make it right though. Cyclist would have been in the wrong.

    While cyclists sometimes don't follow the rules, they run a risk of significant injury when hitting a car, or even a pedestrian. It hurts to crash, I've done it. Most cyclists will assess the risk before running a red light like this one did. I have also on occasion broken a rule or two to increase my safety as a cyclist, but it's not worth fuelling all the rage against cyclists most of the time, so it's better to wait for a few seconds.

      The fact that they're at greater risk of injury doesn't justify it though, I could say the same thing as a motorcyclist. What we're seeing here is most certainly not a case of breaking a rule to increase one's safety, it's an impatient cyclist who doesn't want to wait their turn.

    Just so you know, there is a bike lane on Bourke. It ends just before Collins (where the car turns left) and resumes after Huntley. A distance of around 200m. The footpath between these gap is a shared zone so it's legal for cyclist to be on the footpath.

    I like cyclist but what pissed me off knowing they're on the road despite having a bike lane available. That d**khead would have been riding on the road from the start.

    I think there is wording about cars giving way to all traffic already in an intersection they are entering. Yeah the cyclist is probably breaking the law himself, but you are expected to look right and give way. I think you were restrained not to honk, but even usage of the horn has it's laws.

      If the driver was facing a green arrow then it's highly likely the cyclist was facing a red light. As much as I agree that we should take as much care as possible not to run one another over he's clearly in the wrong and has no right of way in this particular context.

    Most cyclists are scum, a lot of them get angry when they get called out for breaking road rules. I was reverse parallel parking near UNSW last year and this cyclist turned the left corner too fast and ran into my boot, even though I had already stopped and was indicating for about 3 seconds beforehand - I saw him coming up from the rear so I stopped reversing before he even rounded the corner and he definitely had more than ample time to see me. I was more than 15m from the T intersection. He started abusing me and claiming I was liable for any damages he incurred until I pointed out my dash cam. Shame he didn't dent my car at all, because he was definitely in the wrong. I reckon most of them are too poor to own cars, so they resort to the most dangerous form of transport known to Sydneysiders without any care or consideration of other road users. Such a shame he didn't get cleaned up by a car going straight, he didn't even slow down around the corner.

I cycle and just about ever day nearly get taken out by some moron not looking where they are going, speeding, jumping red lights or talking on their phone or texting whilst driving. I reckon most of them are too fat and lazy to ride bikes or walk. Shame they don't crash into each other more

        this isn't Europe, where bikes rule.

      • I rode a fair bit around central Tokyo for a few months. They don't really have rules there other than no accidents. People will cut you off all the time as a given. You can ride against traffic in front of a cop. Riding on footpaths in dense pedestrian traffic is safe. No helmets. Only real rule is no accidents.

        Got back to Australia and the roads felt so unsafe. There is a downside to all the right of way entitlement.

      Don't spread hate. I never run red lights, never ride two abreast, never get in the way of cars and funnily enough, never get any hate from motorists.

      • This. So much unwarranted hate of cyclists in media (social and mainstream). The vast majority of cyclists just want to ride to their destination and get there safely. Same goes for p-platers, they've all got a bad name from the minorty of ratbags.

        I'm not surprised at the down votes of my comments back up above either. Too many keyboard warriors getting all narky because they are the cause of the traffic, while bikes cost next to nothing to run, provide exercise saving on gym fees and don't get stuck in traffic queues.

        Cars run of money and make you fat and angry. Bikes run on fat, save money and release endorphins.

        Cars don't get stuck in traffic, they are the traffic.
