Neighbour Poles in My Property

Hi Ozbargain,

Just asking if anyone has had any experience with the below situation.

I have a property which I am looking at demolishing however there is a Telstra pole right outside. I do not mind the pole but I do mind that the neighbours lines are in my property. Are there any laws that state that I can get them moved without any charge since it is my property and will have mechanical machinery very close to the lines? I will most likely have a private pole anyways.

I have attached a diagram,

Any help will be appreciated

Some one with more knowledge will come along, but off the top of my head, do you have an easement on your property?

    • doesnt that pole also service YOUR property (the OP's property)?

      • I'd say from the OP's diagram, 100% it does.

And depending on the location of other poles, I think they may just have to suck it up.

    definitely telstra, not power?

    • or a private pole.

  • This falls under a different rule its not your neighbors line its owned by Telstra. Utilities are aloud to run through your yard. Its like having a sewage line going through your yard.
I should say to a certain extent of course. You probably could run the lines under ground but it would cost a lot!

  • that pole arrangement sucks, looks to be super inconvenient.

I've got exactly the same issue, really hoping an expert or someone phone with specialist knowledge jumps into this post. In my instance the issue is worse as the neighbor also has a pole outside their home but their phone line comes from the pole outside my place unnecessarily cutting across my front yard.

    Having said that…..

Deabuster, if it makes you feel any better we also demolished an old house and I was ultra paranoid about the look of the wires, demo machinery getting under them etc, now we have our new home I hardly notice them and they don't really bother me as much as I thought they would. If you are building a new home the wire to your new place will be run down the pole and put underground so that's 1 of the 3 you won't have to see or worry about.

    • Certainly not true in Sydney for knock down rebuilds.

In Sydney you have to install a "Private Pole" at your cost inside your property boundary. The electricity is run to the private pole.

The cables are typically buried on the private property thereafter.

  • Yeah that definitely stinks but I doubt telstra would construct such an eye sore without knowing their rights.

    • You might be surprised what some contractors do when installing Telstra lines.

    a bit like this?

is this stemming from a subdivision of an existing block?
