in Victoria, if you're issued a speeding fine where you are speeding under 10kmh, and it is your first infringement in 2 years, you can apply to have an official warning. If granted, you are spared the fine.
I am completely against speeding. I saw a recent thread where the general consensus was to pay the fine and move on. But, under the circumstances that the OP described, it is possible to have the fine waived.
