Police Didn't Return Licence to Me after Random Breath Test

Hallo guys, can you guys give me a solution how to get back my driver licence.

The story is, I was drive a car and the police stop me for RBT, and I had 0% alcohol on me. Until then the police asked me to get out from the car, and told me to check P plate that located at the back of my car next to the rego number, it was a bit deeper but still can see the P, but the police said he just saw a "C" letter not a "P", so I said sorry for that and he asked me to fix it and I did.

After that, he then asked me to come to the front car and I was shock I didn't see any my P on the rego number police asked me again where were the P, I said before it was there I always put there but still he seem like doesn't believe me, he said I should give you a ticket fine. I said so sorry sir i have another P in my dashboard I will put it on, asked me to put it on and just go before he change his mind. I did put it on then he said just go before he change his mind for second time, put the problem is, he holding my licence, I want to ask him to give me back my licence he said just go before he change his mind for third time.

I went home I called police officer to help me to find my licence and they couldn't find any my licence they asked me to leave my phone number, as i need my licence to go to work.

So, what you guys think? Should I wait for the call from police officer? Or sure I go to police station to get back my licence? What if that police lost my licence? Should they give me new licence?

    He should have just given you a fine; so much easier!

    Sounds like he forgot that he had your driver's licence or that he has already given it back to you.

    If you are in urgent need of your driver's licence then you should go down to the station. The problem is that there are many stations. You need to find out which station he is from by telling a police officer at the station where he pulled you over, and as much detail as you can.

    • Do you think he will send me back my license and ticket fine together in the mail? Fine is ok for me as i know it was my faulth, but the problem is my demerit point just only 4 point, and today is double demerit, oohh god…

        Are you worried about double demerits because of not having a P plate? If so, don't worry about it because double demerits are only for specific fines:
        - Speeding
        - Illegal use of mobile phones
        - Not wearing a seatbelt
        - Riding without a helmet

      Sorry, i didnt mean to put it in that way, it just because when i put it too loose then it flew away.
      Just seeing people put a bit deeper then i thought it would be fine in that way, if know it against the law i wouldnt hesitate to buy a proper tool to fit into rego plate number, just another lesson for me.

      In all seriousness, this is the kind of attitude that's wrong with australia, people always worried about other peoples business.

      Why do you even have the thought that you're "tired" or somehow bothered or annoyed by something that literally has zero affect on you?

      I'm not saying people should get away with whatever they want, but I am saying that people shouldn't be so invested in other peoples business.

        I disagree with your comment.

        The reason P plates need to be displayed is to warn other drivers that the vehicle driver is inexperienced and by implication use a greater level of caution.

        The other day a P plater nearly forced me off the side of the Sunshine Coast highway whilst changing lane doing 100 kph. The only thing that saved me was that I had seen the P plate and was more alert for the unexpected.

          After living in a south american country for a while I suggest we do keep each other on our toes regarding following law and behaviour. I have seen what happens first hand when people only care about themselves.

    If the licence doesn't turn up soon then just say you lost it and get issued with another one; the person at the RTA would probably get a laugh out of the story. There is a fee associated with a replacement - this is for Victoria.

    The cop has probably just tossed it into a box somewhere and forgotten about it. Forgive me if I am wrong about this, but I assume that English is not your first language - he may have had trouble communicating with you and just wanted to wave you on. It is OK to politely thank him and then ask for your licence; he probably wishes he had given it back to you as well at this stage.

    Not sure why people are getting snarky about displaying P-plates. They are only a warning to other drivers to be a bit more careful, and courteous, as the person is inexperienced.

    • Yes, English is my 2nd language, i tried to get my license, i said sorry, can you give me baccc.. And he stop me and told me to go before he change his mind, i was so scare to get fine because today is double demerit and i just got 4 point demerit if he fine me a ticket then i cant drive to work.

      As i said, if know it against the law to put the p plate in that way then i would not have this problem. What you said is true p plates should put in the right way to warn the other driver, i want it in that way too to let other driver know that i still learn how to drive and i inexperienced driver, but the problem is, if i put to loose then it will fly away and it happen to me couple of time.

      • My comment wasn't trying to be negative on you, it was commenting on other people here who were getting aggro about the fact you hadn't displayed it. I can fully sympathise with the p-plates coming off, unless you wire them in place they tend to blow off in the wind. If you have contacted the cop station and they can't find the licence then just get another one issued as a replacement. It will involve a fee but you will then be legal again and no demerit points. If you aren't sure about doing this then ring up the relevant authority, google will help here, and explain that a cop stopped you for a breathyliser and forgot to give you back your licence and that you have tried to get the licence back but the station can't find it. They will then tell you if there is any issue with getting a replacement one. Best of luck.

          I just called nearest police station that i got stop by officer, and they have my license, they said they will mail license to me, i told them that i need the license to go to my workplace called me back asked me to get at cop station, ohhh so happy..

          @Barbequemilk: Excellent news. Really happy this worked out for you. My experience with the cops are they are generally pretty good as long as you don't give them lip; however, especially if communications is problematic and they are in a rush, they can get a little abrupt.       • Not sure if it is state law to place them on the outside of the vehicle, but is it not possible to place plates inside your vehicle on the front and rear windows?

        • NSW changed their law about the 10 years ago. It's the only state that requires the "L" and "P" plates to be placed on the exterior of the vehicle.

          From RMS website:

          L and P plates have to be attached to the OUTSIDE of the car – you can’t stick the plates on the inside of your window any more. Penalty: 2 demerit points and a fine.

          Also to note:

          From 1 December 2016, P2 licence holders will no longer be permitted to use a mobile phone at all while driving or riding – this applies to all use, including hands-free sets and phones set to speaker. P2 licence holders will have the same restrictions as Learner and P1 licence holders. Penalty: 4 demerit points and a fine. Double demerit points apply to mobile phone offences during all holiday periods such as long weekends, Christmas, New Year and Easter.

      I dont know where to get a solution, i am silent reader from 2011..
      I went to whirlpool but find out there is no benefit to make an account there so i prefer ozbargain as i can find a cheap stuff

    Using magnetic P plates would solve your problems. They should give them out at the RTA instead of those stupid plastic ones.
    I use them for my daughter's L plates, beats stuffing behind the number plate.

    • When I was on my P plates, I used to use the magnetic one and just totally gave up on them.
      I have had a few of them fly off from the front hood, over my windscreen.
      Complete safety hazard, especially if it hits someone.

      However, I do acknowledge that it is a personal preference. Just saying: Be careful when using them, especially when driving down highways at 80/90 km/h. They will fly off.

        My daughter just did some freeway L driving at 90km/h and they stayed on as I put them on a flat surface. We did have 1 fly off at 70km at an earlier date when she put one over an edge on the bonnet so you do need to choose the spot. You also need to store them flat so there are no corners curled up.

        • I used to just walk into the RTA and swipe a handful of them and put them in the glovebox. As they inevitable came off I just reached into glove box and replace. Of course back then Ps was a year. No idea what it's like now. Wouldn't be surprised if service NSW or whatever they call themselves charge $10/each

      +1 p plates are out there for a reason if you can't display a p plate in a manner you shouldn't be on the road
      I'm sure its not hard to display a p plate its not rocket science
      There are magnetic types also there are brackets you can get where it slides in like I said p plates are there for a reason you should be thankful the copper didn't fine you
      Instead gave you the runaround to think about your actions in the future

        • It is important that other drivers can identify inexperienced drivers on the road
          And I'm sure a lot of them don't display plates so they can exceed there speed limits on the freeway without being detected by cops easily

          Why is it important? Wouldn't it be better to not have them, so that we treat everyone like they might be an inexperienced driver?

          Personally I think P plates are silly. L plates I can understand, because they are new drivers and still learning the roads, so they might go slow, stop unpredictably, make turns at incorrect times..

          But P platers, I haven't seen anyone treat them with kid gloves. Usually its "bloody p plater" or "stupid p plater"
          I can see why you might not be keen to put them up

          True but there are some good and some bad p platers unfortunately the bad p platers pretty much ruin it for the good

      Maybe cut the guy some slack, for a person of NESB he's doing just fine here…
