Entitled for a refund?

Purchased a refurbished Asus laptop from CFOnline and received the item in good time. However, the screen has large scratches on the bottom right corner of the screen and the wrong charger was supplied.

I'm going overseas on Saturday and needed a laptop asap and I shouldn't be the one forking out extra money to buy a charger. The question is: Am I entitled to refund?

yes, provided that the difference between your belief about what you have received and what you were lead to believe you would receive is reasonable.

what makes you think that you have to be the one who must subsidise someone else's breach in ACL? extra money for a charger? … more like "send me the correct charger, and if you include an additional satchel, i'll return the incorrect one back to you."

  • Yes it sounds like you are entitled to a refund. Take photos of all items. Unless it's a fake/counterfeit product, you will need to send it back in most cases.

However it's just your bad luck on needing the laptop ASAP. You aren't entitled to 'making sure you product arrives on time so you can go overseas with it'.

Your only option is to go buy another one, preferably from B&M store.

  • Yeah that's my bad for purchasing so close to departure date.

Their refund policy states that "refunds will only be given if the items are faulty, wrongly described or different from the sample shown". Surely getting sent the wrong charger and scratches on the display fits under one of these.

    • your belief is both reasonable and normative.
on principle alone, i wouldn't let them hustle you out of any out-of-pocket expenses arising from their mistake. optus is the worst, and it actually encourages them to breach ACL in the future.

        optus

        Where'd that come from?!

          @firstworldproblems:

No I don't it's just strange you brought up an unrelated company, it read as though you thought OP was talking about Optus

i accept it was tangential, but i'll put it to you another way: knowingly or unknowingly allow companies to push you around with respect to your consumer rights, and they eventually will turn into optus. so don't let sketchy computer companies start dictating how it is their breach will be remedied.

    • Under the ACL, the wrong charger is not a major failure as it's easily rectified and so the seller has the option to replace or repair at their discretion.

The scratches on the computer on the other hand may be a different story and may mean it's refundable.

  • As to the screen:

    • Near new, may have slight blemishes, in full working order.

    • As they are refurbished stock, there may be very minor surface marks on them and we have inspected several units and they look like new. These refurbished Notebook are re-packaged into brand new packaging (with a serial number and factory seal) , but the contents inside are in the highest possible condition.

"screen has large scratches on the bottom right corner" vs "Near new, may have slight blemishes"

this is what i love and hate about the term "reasonable" as it isn't dictated by what the majority believes.
it's funny, whenever i sell second hand stuff on ebay i always make a point of clearly stating the blemishes and having a close up pic. it's a snake move to start using doublespeak e.g. dents = character, etc.

    Thanks @Spackbace

Here's a link to a photo of the scratches http://imgur.com/a/2ZSUq

A bit worse than minor surface marks or slight blemishes in my opinion.
