Do Builders/Delevopers legally have right to restrict speed limits on Public roads around Construction site (I am in Melbourne)

I know it's an OHS issue (I don't want to kill or hurt anyone) but I really hate it when they are doing it during peak hour traffic. I know they don't want to pay penalty rates but often these new apartments are on main roads and the traffic is bad enough already.

Could I actually get booked by the police? And who determines what speed they restrict it down to and for how long down the stretch of road?

  • Not sure about VIC but In QLD, if you want to change the speed limit on any street (for what ever reason - road works, construction (as you describe), etc - then you must: a) submit a site plan to the relevent authorities mapping out how you are going to restrict the speed (this includes a "site" map, b) erect appropriate signage as per legislative guidelines.

    speeds through restricted sites can only be enforced by police - yes, you can be booked.

    the speed restriction is requested at the time of site plan submission.

  • yes its legal but geez, where have you been. There's been massive building in Syd and Melb.

    Not only speed limits but what about the stream of concrete pumpers, forklifts and brickies pantechs etc.

    Just live with it.

  • I know where you're coming from. One of the big problems is that some of these roadworks signs are just way to long and not even close to where the workers are working. I think a lot of people think the same, they see people working in the distance yet they have to reduce to 40km way before they are even there. I understand if you're on a highway it's different because you're doing 100km, but dropping from 60km/50km to 40km doesn't take very long at all.
