Not Happy With Car Bought From Dealer

I have bought a year old car from a main dealer. The car smelt strong of deodorant when bought. One week later the smell wore off and can smell animal smell.

Examined the car and it's riddled with rats urine and faeces. Have requested carpets changed and aircon strip and clean to remove rats faeces and urine and nest material and also full examination for damage.

I am being told it will take 4 weeks for parts to arrive from Japan.

What are my rights, can I demand a hire car for the 4 weeks, can I reject and get a full refund plus out of pocket expenses?

  Dealer trying to mask it with deodorant, lol. I wouldn't trust them with cleaning it out properly, or double-checking for damage. Rat damage can be very problematic down the track, especially with intermittent ECU faults as a result. Get a full refund under ACL, buy elsewhere.

  I'm pretty sure you're not entitled to a refund for a used car until ACL or NSW law. NSW Fair Trading will just hassle the dealer to fix it, who'll do a shi*t job and you'll wind up in a vicious circle. There's no hope of getting compensation for your time, rental car, etc.

  I would mask it up with some more deodorant and flip it. You'll probably have to take a hit on a few grand (GST, Stamp Duty, some depreciation/deal profit) … but it'll be less hassle in the long run. You'll never be happy with the car, even if you wait for the repair.

    QLD not NSW. Car is one year old, cost $25k so I will take all legal options required unless I get the outcome required. A second dealer is inspecting and repairing so they should do a good job….

      I doubt QLD laws are significantly different to NSW laws, when it comes to 2nd hand cars … ie very weak for the consumer.

      How did you engage the 2nd dealer? Are you paying for the repairs yourself and expecting the 1st dealer to re-reimburse you? That will never happen … you'll just be out of pocket even more.

        So now the 1st dealer has someone else to blame, except that he's in cohoots with the 2nd dealer to screw you over.

        Cut your losses any way possible. There's no good outcome possible from this shitty situation.

    Someone picked it up at a heavily discounted price for a vet.
    But this is insane, rat piss has diseases that are not good to us and you can get very sick from it too so you can agrue the safety aspects of it to get you money back.

    I believe that in nsw there was a lemon law passed years ago that if you did purchase a cwr from a dealer and it was a right royal shitter as in a lemon you could get your money back.
