Illegal Dumping by Council?

Hey

Long time fan of the site but first time posting.
Just hoping to get a few opinions from all you wise fellas out there.

About one or two weeks after our local pickup someone dumped a washing machine and a bed frame in front of our unit block (on the side of the road not actually on our property). Happens a bit maybe because we are on a side road, dunno. Just because of our relationship with
Today I got home from work to find the items Actually on out front lawn. My neighbor (lives in the same building) told me that a bloke from council put them there.

It seams now that our options are to either:
A. Put them back on the kurb which would make us liable for dumping them now
B. Foot the bill to have them removed
C. Try to find out who put them there (no idea how we can two weeks after the fact) and dob them in to council
D. Complain to council that they have now dumped item on our property (no idea if they are actually allowed to or not) and see if we can get them to remove them

Just wondering what would be the best course of action or if you guys and gals have any other thoughts.

My neighbor (lives in the same building) told me that a bloke from council put them there.

They did it and are trying to cover by blaming council.

  • Call the council to come and collect it. Say it was dumped there by someone else.

    Damn gummints!

  • Yes call the council (and or police as it may be trespassing if it's on your land) and explain it has been illegally dumped.

Even if they can't help directly, they may be able to offer some advice. The council might be able to waive the disposal fees if you take it to landfill.

Otherwise the items might be good for scrap metal value or firewood (if the bed frame is wood). Take photos and advertise it as free stuff on Gumtree. You might be surprised, someone may actually want them.

  • But seriously, once had someone dump shit on our verge (corner block, other side of side fence). Council worked came to our house (obviously a neighbour had put in a complaint about the stuff dumped there), told my Mrs that we'd have to prove it wasn't ours! Stat dec etc! The dumped stuff was pool building equipment, and any nupty could see we don't have a pool! Mrs explained this, but was still handed a letter…
Less than a week later (nothing done on our part, hadn't gotten around to it), it was removed. I reckon someone at the council came to their senses and realised it wasn't ours, but couldn't prove ownership, so they footed the bill.

Long story short, stat dec should make it not your responsibility. Easy enough to arrange one if you know an accountant/nurse etc. Send it to the council, stating that it's not your property, have them remove it. Your neighbour should do the same.

Side note, you live in a unit block, why so worried about it? It's strata's problem isn't it, not up to you as an individual to deal with issues of the property?

There is no wonder why people say that council are a bunch of power hungry "insert word here". The presumption of innocence requires that they have to provide evidence that you or your wife are guilty of an offence, and not the other way around.

i've just had to tidy up after someone stole from a hard waste collection and dumped them on my property and on the nature strip. I don't agree with this, but just to be safe, do it with no witnesses around

    Go with A

  • Just go with A, then report it

  • Call the police or council (not sure who would deal with this) and make a report.

Put it on Gumtree. Someone will come and get it for you. If the bed frame is half decent put $20 on it.

I had a broken oven, someone off Gumtree came and collected it for scrap metal.

      This is good advice.

You could also contact this business that buys scrap metal. http://www.scrapmetal.com.au/personal/what-we-buy
Their website does mention they buy scrap white goods.
You could just give it to them for free if you want.

    • And if it's just before a council pick-up, put it out the front and wait for the scrap-metal guys to come around a day early. :p
