What can I do dealer fail to delivery my new car ?

Hi all,

I need your help. I purchased new Hyundai car in the end of June . I was promised the car delivery mid sept. I called them a few weeks ago n I was told it will be 2 weeks late as the car still in transit to dealer, but no later than end sept. Then today I called again they told me that my car saleman who sold us the car has resigned n my car still on the boat. They can't give me a date or anything when my new car will be here.
What can I do in this situation ?
They are ridiculous with all the lies…

    what does your contract say?

    you haven't read it?

    best read it now then realise that the dealer only has to make best endeavours and that 'run of the mill delays' are not his problem

      Yes, that's the situation unfortunately.

      If it bothers you too much, you could have the contract cancelled and perhaps the deposit reimbursed… but it could be a battle to get that solution.

    Yes read your contract. It will tell you how many days after initial delivery date you can cancel contract if delivery not made.

  • Read the contract. If it does not say anything about cancellation and/or late delivery. If the contract is not clear, then you are in murky water. Read this thread - perhaps insist on a loan car.

    Happened to my friend with Skoda and they demanded a loan car until their actual car delivered… dealer obliged

      Yep. Loan cars are the bomb. Can go nuts and drive like you stole it.

    Our contract conditions give both the customer and dealership 3 months to supply the vehicle. If the vehicle isn't there within 3 months, either the customer or dealership can terminate the contract. So in your case, you'd be perfectly able to break the contract (though it's likely that the dealership would then do whatever they can to retain the deal).

    Unfortunately you've dealt with a shit salesman who just kept stringing you along. Try dealing with the Manager, who may be willing to help to sweeten the deal further (Free loan car etc).

      that used to be a valid opinion, nowadays anyone that hasn't kept up with progress made by Kia / Hyundai, is an ignorant fool

      personally i don't like them, but they have advanced so significantly in the last 3-5 years, if you dismiss them, you are probably a Honda driver (cos they did used to be good, 10 years ago didn't they?)

      Holden used to make good cars, same with Ford - times change

      Jaguar are now making great cars. Tata is not a good Indian car company. Hang on, Tata own Jag……

  • We bought a Tucson Disel highlander. I read contract it said we can't break contract until 60 days after estimated date which means Nov for me .
    But we really want this car… I will call the manager again tomorrow see what they going to do.
    I got feeling that they might have sold my car to someone else 😖

          The way the Korean stuff is headed, I'd rather have a Hyundai than a European car with their DSG and emissions issues (yes, I'm looking at VW)

    That's recommended retail price..
    If you paid 50k then you got problem.
    I don't believe anyone here won't negotiate price.
    I m not being inpatient jst they told me it had arrived oz n in transit then after two weeks it still on the sea somewhere.

    • emiko I am wondering how hard you went in on the price, you left some margin didnt you? Perhaps they are selling it from under you or perhaps there is a shipping delay. One thing is for sure - you don't have your car and that is unusual..

      Ask the manager, how much more to get one today? you may have an interesting answer…

  • Just be patient, you need to be prepared when you do a special order for a new car. If you were not prepared to wait then you should have searched hard for one which was in stock and ready to pick up. I am sure it will be worth the wait.

  • Talk to the dealer if you have no joy give Hyundai Australia at Macquarie park a call.
