Capark Tenant Owes Me Money

Hi All,

I've just joined Ozbargain and I believe this awesome community could help me out with an issue I'm currently facing, so here it goes.

I have been renting out my carpark space to the same person for quite some time (slightly over a year). He missed a payment 4 months ago, but since he had been making timely payments from the beginning, I didn't take any immediate action.

Same thing happened for the second month. On the third month I decided to contact him. He claimed he paid for the prior 2 months, but would check with his partner. After somemore 1exchanges, excuse after excuse and unfulfilled promises to make payment (I will spare you the details), he still hasn't paid me but have been parking at my carpark lot.

In the 4th month (now), I decided to install a foldable parking barrier. So now he's not parking his car in my carpark but he still owes me 3+ months of rent.

Is there any possibility I could get this rent money back? Maybe through legal ways or the police? I know it's not much, around $900, but money is money right?

There wasn't any written agreement, only verbal. And I only have his car plate and mobile number.

    It may only be a "car park space" but a contract is essential when things go pear shaped.

      Agree. Without a written agreement, it's almost impossible to prove to anyone that the person owes you money.

    You will need to chalk this up as a life lesson. Give someone an inch, they'll take a mile.

    Put up a private parking sign in your spot and open the barrier. Get a wheel clamp and when he parks there, then pounce. If he calls the cops, argue it's a private park and the sign says as much, come to an agreement to pay the outstanding to release the car, and keep calm.
