Hotel in Melbourne: minimum check-in age is 21. Is it legal ?

I tried booking a hotel for a person who is 19 years old (no criminal records, full time Adelaide Uni student).
I could not do it because as per their Web site "minimum check-in age is 21."
I called them and asked.
They said that it is their policy.
I tried to explain them that it is discrimination.
They said that it is their policy.

Can anyone especially with some knowledge of legislation would advise me on this. Thank you.

      A hotel isn't the same as renting a house.

      Six year olds aren't allowed to drink, smoke and drive.

      • The Act doesn't seem to define 'accommodation' other than it includes residential and business accommodation. You would need to take it on it's general meaning in this case which I think would likely include hotels which do provide accommodation (albeit temporary accommodation).

        • Hotels aren't residential accommodation though.

        • @Drew22: Which is why the act uses the word 'INCLUDES'. 'Includes' means the list is not exhaustive. There's no wording in the legislation that I saw (albeit I looked at it for about 30 seconds) which would indicate hotels are excluded.

  • under 18 policies can be applied, apart from that it is age discrimination if it is in Australia.
    If you are booking overseas its a different story. We went through the same thing for schoolies
    once you go to put the report in most places I encountered back peddled quickly.

      There are exceptions… ie hiring a car a lot of places you need to be over ~25 and for sports/high end cars over ~31 years of age.

      • I was referring to hotels, but you are right on car rentals. I think it is about insurance.

  • Two options:
    - Look for another hotel
    - Annoy the hell out of them until they accept it should be 18yo (or even less).

    • I had to book another hotel.

  • In Victoria it is against the law for someone to discriminate against you because of a personal characteristic that you have, or someone assumes that you have. These personal characteristics are things like age, race, disability, physical features and political beliefs.
