A curious question.
I happened to buy a Motorola style x when Vodafone was clearing them out in may, doing the "going on a plan for a month" and then cancelling the plan.
If my phone develops a defect or a problem, can I take it back to Vodafone?
My understanding is that I should be able to return it to the vendor if under one year under the usual rules.
However, the voda website suggests that their repair warranty on covers devices on a plan.
I suppose that having a phone on a payment plan means providing a working phone is a part of the service contract to you.
What might other ozbargainer houghts be?
Is it clear cut?
Vodafone are required to deal with any issues with the phone under the Australian Consumer Law and the consumer law works on the very unreasonable logic of a "reasonable person". How ever long a reasonable person thinks a product should last is how long it should last.
You are right that phones purchased with a 24 month contract are required to work for 24 months. It's pretty reasonable if you buy a device to work with a service for a set period of time the device works for that long.
Vodafone's repair policy does state that you need to in in contract but that is bullshit… and I would say a breach of section 18 and 29(m) but I digress….
But the bottom line is they have the line, Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. This is what you'll be relying on.
