Did I just get scammed!

I bought 2 adidas leggings from this seller on eBay. Paid $60 + $8.95 P&H. I should have known better than to buy from someone with only one review. I bought these leggings because I thought they were genuine. This is what the seller wrote:

Good afternoon customer , l have just checked the leggings that we have sold to you are not the same quality like we sold before , the reason from the factory that we have ordered , sent us the lower quality items . l am so sorry and try to fix this ,sincerely , l want to give you $10 discount to you for next time you purchase with us , we promise, next time you purchase items from you will be very happy , because you will get very cheap and good quality .item from us , we will keep higher standard and wont let anything like this happen again . or if you want to return the item and you havenot worn and washed it .we are happy to give you refund money next month ( refund money not including postage price and paypal and ebay fees ) , thank you very much to understand and give us a chance , l am so sorry and apologize again , l wont let anything happen again .

I have yet to see the goods but judging from this letter it looks like it is not genuine adidas. What do I do? Help? Is there a way I can get my money back including the postage and handling?

    You have couple of options here, once you have received the leggings and then you can contact the seller for a full refund(if it stated that it is genuine), if not it will be up to the seller how they handle you, but you could always open up a case as not as describe then ask seller to cover the return shipping cost and send it back to him for full refund.

    Or just accept what he propose, but if I were you I would not accept as $10 need to spend again on them which you have already lose confident on them.

    post back at sellers cost and DEMAND they refund you the full purchase price PLUS return shipping costs.

    Had one guy try to do this to me once. Rang the ACCC and the Retail Ombudsmen. They contacted the seller who of course shat themselves and cooperated immediately.

    Also, if you paid via Pay Pal, they will take care of this. Just raise a case and dispute it.

    I paid with PayPal. It did not say it was genuine but it had Adidas on the title and it shows pictures of genuine adidas. I know because I saw the same picture on asos that's why I assumed they were genuine.

      I think if they say the brand name, it's fair for someone to think its the real thing. So you're not wrong to believe its real.

      Just dispute the paypal transaction, and send paypal the message that he sent you.
      Paypal will just refund you, you don't have to return the item. (Since the seller has admitted liability.)

      If you paid with PayPal, you'll be fine; just open a dispute within the required time-frame.

    Their cost is probably very small for cheap quality item. Id tell them if not genuine, you want full refund or will open PayPal dispute. If they are not genuine, PayPal will make them pay return shipping, and you will get refund. They will probably just refund full amount and let you keep item because return postage may be more than cost of the item.

      Even if it IS genuine, the seller has admitted that the quality is not as good. IMO this means that the purchaser has the rights to a refund under the ACL.

    You can't sell un-genuine products on Ebay. ie. rippoff nikes or Adidas.

    So just raise a paypal dispute saying item was not delivered as described.
    I find paypal cases work faster than ebay cases.

  • there are many fake 2xu on ebay, some local seller but they bought from overseas.
    checked aliexpress, yes there are many, with the 2xu logo, but without box. somehow they are able to copy the product but not box? seller will say sorry no box to save postage fee, and cant provide photos of actual products, they just listed with pictures from internet.

    hint: always ask for box and tag if buying brand new, and RECEIPT from LOCAL stores.

    Paypal dispute it as counterfeit, you will probably get a refund and get to keep the item.
    If things become difficult, I'm sure the seller wouldn't want to deal with Adidas themselves… /nudge nudge

      Mind you they've also stated that it has the 'Adidas logo' in the title not that it is Adidas made. Sellers like this need to be hounded off the internet.

  • I'd be asking for an immediate refund. If they've already posted them, then they can be returned at the seller's expense.

    The seller's english is horrible but they claim to be in Australia. What they've done is a breach of the ACL (selling goods and sending out different quality).

    On top of that - They didn't even offer you an immediate discount only a discount on your next purchase?

    Stuff that for a joke.

        They refer to the OP as a 'customer' they talk about buying and reselling leggings previously. They're posting more things they're obviously reselling for profit.

        It would likely pass the test of whether they are 'carrying on a business'. They might be a new business, but they're still operating a business and the ACL would apply.

        What makes you think they aren't operating a business?

    The seller is probably a 16 year old kid, who is drop shipping from a supplier, and has been conned by them as well.

    However even if they are, its NOT your problem. It will give them some life experience, that just setting up an ebay account, drop shipping product, isnt the way to make their fortune, even though books found on the internet claim others have made their fortunes this way.

    Dispute the deal, like others above have rightly said. Get your money back.

  • I still haven't received the goods yet. Should I wait until it comes or file the dispute now? What are the chances of it being fake compared to it being real adidas? Also mine did not say "adidas logo" mine simply said "adidas" and in the description it said "The adidas Originals Linear Leggings are crafted from breathable, stretch cotton for the ultimate in comfort.". What do you think guys? Do you think I should ask the seller if they are genuine?

      To be honest, I think you're freaking out a little bit too early. If you file a dispute for counterfeit item or not as describe, you still need to provide proof to ebay/paypal afaik, which you don't have yet because you don't have the item. What if the item doesnt arrive, would seem weird to file a SNAD followed by Item not received dispute. Imo, their message doesnt admit counterfeit, just lower quality or maybe seconds, it should be more apparent once you get your item. Don't close too many doors so early on.

    • you need to receive the item first. Once you have, just hit 'Return this item' in 'My eBay' and you will be given a choice to communicate with the seller.

      Pick that option first, I think you will have a 50/50 chance that the seller would cooperate. If not, Paypal steps in.

      The fact that the seller owned up to selling you something that 'is not as described' is actually a good thing. You need to save that message and show it to Paypal — that proves that they have sold a counterfeit item which is against the law (but most importantly against the rules that ebay has set).

  • Is it tracked postage? If not, you could either:
    a) raise a dispute for goods not received
    b) refuse delivery of the parcel and allow it to return to sender, then raise a dispute for goods not received (even if tracked)

    Option a is a little dishonest but both of these options absolve you of responsibility of paying for return postage. Given that the seller has admitted the goods are fake, no reason to feel guilty.

    PayPal refunded returns for shipping. Google it

    PayPal refunds the shipping cost of returning an item, it's done easily and I've done it successfully for at least 6 items, some overseas with tracking where shipping was close to $40 to send the item back.

    Easy, return the item with tracking, you'll get your full costs refunded including return shipping

    Yes, you have been scammed. I would get straight on to PayPal, as they have already admitted that the goods are not to standard.

  • You've possibly bought an imitation product but the vendor is essentially admitting to it so I'm not sure how that is a scam. If you're not happy with the sound of the email upon receipt just do a return to sender without opening the package and you'll incur no return shipping costs. If you don't receive a refund - next month is tomorrow so you shouldn't have long to wait - forward any corro to paypal and they'll sort it for you.

      It's a scam because they bought one thing and the seller is sending them something of 'lesser quality' (they don't admit it is no made by Adidas) and did not offer the option for a refund only a discount on a future purchase.
