Multiple Fixed Term Contract Rollovers - Classed as FT Employee After Certain Period?

Hi guys,

My friend has been employed in the public service for almost 4 years working on a fixed term contract agreement which keeps getting renewed for a year or 6 months each time (same job duties). From working in another country overseas and being fixed term myself for a time, I recall a law stating that if you were employed on a fixed term contract for over a certain number of years, you would be classed as a full time employee of the business in the eyes of employment law and could ask for a full time contract for a permanent role.

I am having difficulty finding any information on this topic for Australia apart from a few bits about the employee expecting renewal of the contract due to previous renewals.

Can anyone shed any light on this?

  • In Vic Gov max period is I think 3 years. Problem is that the employer may turn around and advertise the role and your friend may loose his/her job. Best solution is ask your fried to join the union and approach them with his/her case and a few other examples to get them interested. Union is usually not interested if it is a singular issue, and pre-existed prior to becoming a member. Having said that CPSU Vic is currently running a secure work campaign, you can register for that if you are in Vic Gov. The new Vic Gov agreement also requires employers to offer secure forms of work.

  • anything in SA my wife is having the same thing with University of Adelaide position is offered as 2 year fixed then in December she will be offered another 2 year term.
