Interesting piece on Secure parking on ABC's The Checkout last night. It detailed the terms and conditions of parking with Secure including the right to impound your car whilst still changing you daily parking fees and the right to sell your car to recover parking costs.

It's a worrying revelation from the Checkout.
It's in the t&c as you enter. Once you enter you've agreed to assign them rights over your vehicle & they can enter it, & sell it (to recover fees & costs).
A bit similar to agreeing dry cleaners can sell clothes not picked up after a certain length of time.

I've never seen or read any t&c's when I've entered their carparks, therefore I've never agreed to them.
They'd need to prove that I have.

To be parked on their premises, you have to pass the t&¢ (at boomgate). The t&c give you the option of leaving immediately if you don't agree. By parking, they consider you have agreed to those t&c, whether you read it or not. Normal situation at many car parks.
I'm glad I take public transport to areas requiring paid parking.

I drive up to the console and enter my pin code and the gate opens.
I've never read them, and never agreed to them, but the gate still opened and let me in.

Many premises have t&c at their entrance that you implicitly agree to as a condition of entry. (eg Shop staff can search your bag over a certain size as condition of entry)
A common practice on the internet… to click "agree" to all those t&c you read before entry.
But some just enter my pin code and the gate opens. 😯

Secure Parking T&C
(shown at car park entrance)
Clause 6 You grant us a "security interest" as defined in the personal Properties Securities Act 2009 to secure everything you owe us. (A legal claim over your car)
We may retain possession of the Vehicle until everything you owe us in respect of the contract had been paid. (vehicle impounded)
Parking fees will continue to accrue during the period that we retain the Vehicle until we recover all fees and costs. (we charge to park vehicle while impounded for up to 30 days = could be over $2200!)
If amounts due to us remain unpaid after 30 days you agree that we can sell the Vehicle and use the proceeds to pay the amounts you owe us
7. We reserve the right … to enter the Vehicle and to move it if we … consider it necessary for the … efficient operation of this Car Park.
