Will I Be Able to Somehow Avoid Foxtel Termination Fee?

Hello, this is my first post and I am looking for some guidance from OZ-bargainers. Last year (Feb 2015), I stupidly agreed to accept a 24-month contract with Foxtel broadband and TV. The sole reason I chose Foxtel was because the only thing my household watches on TV is soccer - EPL besides the occasional free TV shows. Besides that, we really have no reason for Foxtel.. which leads me to my current problem. Optus got EPL rights for this coming season and so, of course, I would like to swap to Optus but I really wish now that I wasn't on the contract as I will now have to pay the $300 termination fee. I know this might be a really silly post but I guess I'm just wondering if anyone out there has ever had any chance of avoiding paying the termination fee via some sort of explanation to Foxtel.

    Hmm… It's a tricky one, as it relates to licences and all, but you could argue that your Foxtel service no longer fits the specified purpose of your subscription.

    • I agree with tomsco.

      This can be done and has been done in the past.

      At the time, you signed up to a service for a particular product. The service no longer provides that product. They have broken the terms of the contract nullifying the agreement.

      You will need to push hard and not accept no for an answer.

      If they refuse then escalate it to the ombudsman.

    • I am in the same boat but I signed a contract back in April this year. Will I still be able to argue that it no longer fits my purpose? I was under the impression that BEin sports would show the games live and not delayed.
