After some advice in regards to a situation I have:
Purchased a mattress from Snooze a week or two ago. Paid in full and will not receive mattress until the end of May when we move into our new house.
Have since decided that the mattress purchased is a bit too soft and from reading reviews is prone to holding heat in the summer. As such we advised snooze that we would like to swap to another mattress we were considering (which was cheaper by coincidence) and have the difference refunded (around $300).
Snooze has refused to refund us the difference and offered to swap for the mattress we want and credit the difference in store as a 'good will gesture'.
Do I have a leg to stand on in trying to get this refund? I would totally understand not getting a refund or even store credit had we already taken delivery of the mattress. But I feel because of this it's not inappropriate to seek a refund.
Any help or opinions would be greatly appreciated!
Whether you've taken physical possession or not wouldn't make a difference, as under the Australian Consumer Law retailers are not obliged to offer you a refund or store credit if you simply change your mind after purchase. Not having taken physical possession of the purchased item doesn't change the fact that you've already purchased it, as evidenced by
In fact, Snooze is doing you a favour by allowing a swap in the first place, and the offering of a store credit for the difference is a goodwill gesture along with the swap.
The worst case scenario would be them saying 'No, you must take delivery of what you've already paid for', so my advice would be to take what's offered before they change their mind because from a legal standpoint they're already doing more than they're obliged to.
