eBay Office Chair Gas Lift Failed in under 2 Months Seller Wants $30 for Postage of a New One

It's been 54 days since I ordered the office chair and the gas lift has failed and will not hold anything up but the chair itself when not being sat on.

Seller just messaged me back asking for $30 for postage of a new gas lift.

Seems unfair that i have to pay that for such a new chair.

Chair itself only cost $115 brand new.

What are my options.
Would paypal help? or ebay?

    you could return it for a refund. either way it will cost you some money.

    Hmm, just based on this week's Checkout episode:
    - if it's a one-off sale from a private seller then ACL doesn't apply and anything goes
    - if the seller is also a business then ACL does apply and I'd say that your issue constitutes a major failure of the good. In that case they would have to reimburse you for the return postage and you could get a refund or a replacement for free

          that could be, but how do you suggest op getting the seller to reimburse the cost of the return shipping if they don't want to?

          If they weren't already aware of their responsibilities then you'd have to point them to the relevant clauses in ACL. If they still refuse then you'd have to take it up with the ACCC as a breach of ACL. It would probably be a painfully slow process (perhaps not worthwhile) but it'd do the job

          the accc won't do anything for $30. they'll tell op to contact op's consumer affairs. that would be nsw fair trading. fair trading will ask the seller to address op's claim. the seller plays hardball and says no. op will be back to square one when fair trading says that they can't force the seller, and that they've done all they can to help.

          That all sounds highly anecdotal to me. All I'm saying is that the seller would be entitled to a refund/replacement and reimbursed postage costs under ACL provided that it is a major failure and the seller is a business. Whether or not the seller abides by it and how effective the agencies are in enforcing this are other matters all together.

    Have you tried turning it upside down and pressing the lever? This would let gravity pull it out, some online articles report this fixing the chair Link. I'm guessing $30 is around what one of these gas canisters cost? I guess you could complain to eBay, so you could edit feedback or complain further but doubtful of any outcome.

  • Did you purchase a new chair or a used one? And if it was new, did it come with a warranty? Also, is the seller a store with an ABN?

    Tell the seller that you don't see why you should have to pay for shipping. The warranty is 3 years and it has a ABN so they have to ship one out to you for free.

    Paypal will probably cover the shipping however. Ask the seller for a receipt for the shipping and a photo of the new gas cylinder and a photo of the parcel with your address.
