We live on a few acres we have almost no trees at all but the neighbour has plenty. There is a driveway to a property behind us and the power pole is on that driveway but powers a small old house we have at the back of us. Today we come home and there is a tree branch from the neighbours property that has fallen across the line cutting out the power to the house. We call our electricity company and as it is a private pole they are not interested. My question is who pays for it?

they are responsible
if the limb of a tree that has it's trunk in their property, damages anything on your property, it's on them
Insurance and they will recover from your neighbour.

What state do you live in?
Wouldn't the local Counil be interested in thier assess going down when in a storm, trees bring down the wires?
If a tree (on your property - so theirs) causes damage to neighbouring property, then the owner of the tree is liable.
