eBay Purchaser Rights

I have recently purchased a laptop off of eBay from the Futu_Online store.
The description of the laptop was new but when i received it the seal was broken.
I thought it must have just been a tight seal and have broken in transit, so I set it up and it was unbelievably slow to the point that there must be something wrong with it. It was slow and kept freezing when I tried to do anything.
I had a closer look at the box and there was a cut on the cardboard behind the seal as though someone had cut the seal with a knife or other sharp object.
I have now come to the conclusion that this laptop was sent back because it is not working properly and they have just posted it to the next guy who ordered one.

I have contacted the seller requesting a refund and told them basically what I wrote here.

They said that they are happy to refund the product but there will be a charge of 15% because the seal is broken and I will have to pay for the return shipping.

I have told them that I will not be charged 15% and they will be paying for the shipping as they have sent me a product different to the item description.
I am now waiting for their response.

I paid with my credit card through Paypal.

Just wondering what my rights are here?

Has anyone had a similar experience? What was the outcome (good or bad)?

    Go to PayPal and make a SNAD claim. Attach pictures to confirm.

    since you used paypal you should be able to send it and paypal will pay the postage

    futu online is generally pretty good, they should just give you a replacement laptop if it is faulty on delivery …

      I kind of don't trust them now and I'm a bit sour that they're trying to charge my 15% when they have sent me the dodgy product.

    Do a PayPal return and file a item not as described claim on Ebay.

    15% and paying for postage is outrageous. I hope you took a picture of the box when you received it. I probably wouldn't have accepted it if it wasn't sealed.

    Check through their recent feedback on ebay and see if anyone bought the same model of laptop recently. If someone has and left neg feedback take a screenshot.

    I was going to order a hard drive through them but now I'm thinking no way…

  • Was the description new or brand new?

    Brand new and you should expect sealed package.

    New and the packaging is either missing or not sealed, as well the item might be a factory second or an unused item with defects.

    These are eBay selling guidelines.

      No I am not a technician and no i did not find a fault with the computer as I wouldn't know what to look for.
      The fault is that the package was not properly sealed, If it was I would have probably just worn the fact that i wasted my money and would have tried to use it as best I could.
      But the fact that it has been previously opened leads me to believe that someone else has returned it. Why else would they open it?

      On a side note, If you're going to act like a douchebag please do it somewhere else, that is not what this site is designed for champion.
