Havaianas Australia - Won't Cover Defect As Were Purchased From Aldi

Hi All,

I got a pair of these off my grandparents for christmas, they sent me them down from QLD to NSW.

They're defective on where i put them on and they slice in-between my toes.
They were purchased from Aldi.

I sent them an email to get them replaced / send them back to them, and they respond with

"Unfortunately we do not cover pairs purchased at non retailers. I would suggest contacting Aldi and letting them know you know Havaianas Australia offer a 6 month warranty and ask if they can match that .

Since when does it matter where i purchase something to get it replaced under warranty?

What are my options here?

    • I don't believe my grandparents have the receipt from christmas. i've already asked them.

      But since when can they refuse a warranty request from a manufacture defect, it shouldn't matter where i've purchased them for warranty.

        Without a receipt, how do you hope for a warranty repair? How do they (Havaianas) know it hasn't been longer than 6 months?

        • Because they're brand new and look it - can use credit card statement as proof of purchase too.

          It's actually not besides the point, if you can't prove the purchase then there is no warranty. Even a credit card statement is really only proof to Aldi, not to Havaianas.

          All I can think of, is unless they're an authorised reseller, they could be grey importing the product. In which case, there's no warranty through Havaianas Australia. You would need to go to Aldi.

          @Spackbace: I reckon this. Won't be classed as a product from Havaiana Aus. Becuase it's not a product the Aus arm manufactures, if Aldi wanted recourse, they'd possibly have to goto to Havaiana China (for example) or their wholesaler.

    From the sounds of it, it may be a parallel import? Or aldi did not buy from the proper Australian channel? If that's the case, you can only go to aldi for assistance as Haviannas Australia are not the manufacturer in this instance and therefore you have no recourse with them.

  • Under Australian consumer law, it's up to you whether you want to claim the warranty directly from the manufacturer or through the retailer. One cannot legally tell you to go ask the other.

      NO, but they can ask for proof of purchase…one would think?

      • I haven't even been asked for proof of purchase, they just asked where i bought it from and i said where. then they sent the email that i posted above.

        • Maybe you should not have mentioned it was from aldi. Just say you got it as a christmas gift.

      The manufacturer most likely does not a presence in Australia. This would leave Haviannas Australia as the importer. It sounds like Haviannas Australia are implying to you that they did do not import the items sold by Aldi, hence you need to go back to Aldi or to their importer. (as the actual importer would be considered as the 'manufacturer' under the ACL.

    The Havianias purchased at Costco/Aldi/reject shop etc are not the same quality as the ones purchased from surf shops/Havianias direct.

    • Not true. I think Havianas in general have just dropped in quality. I bought a pair from a surf shop and they lasted no longer than two months (and they were only worn a few times) before it broke. I didn't bother with warranty because I didn't keep the receipt, but I did promise that I would never buy another pair again. $50 for a pair of thongs that don't last more than a few wears isn't worth it in my books!

    Havaianas are notoriously unreliable. I had to exchange a pair three times with broken straps and in the end the staff member offered me another brand. That was three years ago and they are still going.
