      You have the right to ask for a repair, replacement or refund under the Australian Consumer Law consumer guarantees for products and services bought on or after 1 January 2011.

      .. When you have a major problem with a product, you have the right to ask for your choice of a replacement or refund…

      What is a major problem?

      A product or good has a major problem when:

      … it doesn’t do what the business said it would, or what you asked for and can’t easily be fixed.

      The way I see it, under Australian consumer law you are entitled to a refund.

      • You are entitled to a refund from "Dick Smith Holdings", the problem is that "Dick Smith Holdings" doesn't exist anymore. A new company with the name "Dick Smith Holdings [Administrators Appointed]" or whatever it is in this specific case is not entitled to do anything for you as they are a different company under different management. It sucks but unfortunately it's the way it is. I think the law should be changed to protect customers better when companies go belly up.

    They forgot to include the long list of exclusions

    • Excludes everything except Eneloops.

  • If they go into receivership again, then all bets would be off. NO one can guarrantee what they are saying.

    Even Banks cant guarantee funds, these are guaranteed by the government

    • The current receivers are responsible for the commitments made. The small number of products sold in this period will not end up a big liability, compared to those sold prior to receivership.
      It is likely to be honoured, in my opinion.

    Why are you pointing out some lies and misleading language of a press release? There is literally nothing useful at all in these words since they have been concocted in order to decieve people. In fast I suspect most people are worse off for reading it - that time could have been spent not reading it.

    seems mad not to say that money paid via the website is safe(if goods can't be fulfilled etc), the near silence has been deafening, dicks dead.

    This DS letter is all about trust. We already trusted DS and bought their gift cards. What we have here is double-dipping trust.
    You gotta hand it to them. They know there'll mugs out there who will keep on coughing. There's no patches for this addiction.
    The sooner they disappear from the Australian landscape the better.

  • Hmmm … so I just got back from holidays and caught up on this whole bizzo. Pretty crazy! Sneaky financing!

    Anyway, I bought a laptop last year 2nd hand, but was originally from DSE. I have the original receipt, and the person before me actually bought the +2yr extended warranty which expires in 2017 sometime.

    Anyone else in the same boat? I am assuming the extended warranty will mean sweet FA if the brand goes under, or even if the brand gets bailed/bought the new owners don't legally have to honour it?

    Man this is a terrible letter. It's basically saying to trust them but gives no reasons to do so. If they were really concerned with what people thought of the Dick Smith brand they'd have announced in the email that they would accept gift cards…

    All this letter seems to be designed to achieve is to get us to buy as much crap as possible before they shut up shop forever.

    Just got off the phone with them trying to get a product that was suppose to be delivered before the holidays. (before the receivership). Long story short I never got the product. They are still saying they dont give refunds. called the hotline and they confirmed.

    I wouldn't advise anyone to order from their website, as many others commented as well. If you are going to take the risk and try, make sure you have the product in hand, and fully tested it in store.

    And how can they promise guarantees will be honoured if their business may not be around to honour them?

      They will never honour the giftcards again as that is the only way to cut down their liabilities when they are preparing the paper to sell the company.

      They dont have to win the customers back. They want new customers. LOL.
