I can't speak to other states, but for NSW, these Windows licenses are only upgrades. Though of course you can upgrade from a non-activated earlier version of Windows, or just do a clean install from upgrade media, then call Microsoft to activate.
Like @doofus said, they're only upgrades. I've just bought all the parts for my computer hoping I could use my sibling's Windows 8 copy provided by their school only to realise that it said it was an 'Upgrade version', not a complete full installation.
Just about to ask the same question…been using activated version for too long, I guess now that I am able and well fed, I can afford to give back to the IT economy a bit..

Then I bought it again from the moderator and it has been fine.The moderator costs a bit more, but you get peace of mind.

If you have an existing copy of windows.
If you use the "upgrade now" option with the windows 10 media creation tool (but don't create media) on windows 7 or 8, then you will be given a fresh new genuine windows 10 digital key straight from microsoft.
The only requirement is that in your system properties your windows installation is considered "genuine".
So as long as you can get it to say 'genuine' on your previous installation through whatever means, you will get a new genuine key, if you catch my drift…………. Windows 7 professional is a good starting point because it will give you windows 10 pro.
I know it sounds hard to believe but it's very true, this is just how it works. Microsoft have done a very good job of keeping hush about this, but this was effectively what all those news articles about "microsoft is giving pirates windows 10 upgrades!" were about. It was because microsoft planned to not plug that hole but rather keep quiet about it.
So how do you get 'an install disc'? What I mean is, my quickest and easiest solution to whacky Windows problems has often been to fdisk the HDD, reformat, and reinstall Windows. How do you do that now without Win 10 on CD?
install windows 7 from either a DVD or USB, and make sure that it states it is genuine in "System".
Then on that computer you go to here https://www.microsoft.com/en-au/software-download/windows10 and click "Download tool now".
Once you open it, you want to click on "upgrade now". There will also be an option at some point to choose "Keep nothing" rather than "Keep everything" which will give you an entire fresh install.
It will install it without needing to create any media, you just need internet connectivity. You will be automatically given a digital key which is automatically inserted and automatically activated.
edit: in terms of re-installing windows 10, I haven't done this yet, but I do think you can use the media creation tool to make a windows 10 disc. You shouldn't need a key, as if you have installed windows 10 on the system before then it SHOULD be detected and just automatically activate.
I still don't get why people pay for Windows, especially those careful with money.
Because that loader you are using on creaky old 7 or a dodgy KMS server for 8/10 isn't the definition of reliable or safe.
OP, OEM. Win 10 OEM x64 Home, or you can use a 7/8/8.1 licence key for Win 10 1511 with the media creation tool.

Yeah I find the OPs problem genuine… Tried to do this recently for a relative, and unfortunately the best I could find was OEM from a b2b computer store in their local town.

How about buy very old Windows 7 laptop that has the license sticker in it, use it to install and upgrade to Windows 10 for free.
The media you can download for free.

A very old Windows 7 laptop is at worst, from late 2009, early 2010. Still has some value unless its broken.
Then if you still think this would work you dont understand how OEM activations on Windows 7 limits you from installing outside of that manufacturers product.
If you were going to that trouble there are easier ways, ie. preactivated isos.
Only my tablets have Windows installed without serial number shown anywhere. Those you cannot rip out, I know.
I have 6 laptops and several desktops in my household (I am a crazy IT guy I know) and all the laptops and the desktop have the Windows serial number shown. I have taken one serial number from other laptop and installed the OS to another, then upgraded from Microsoft's website, no problems there.
I do remember once calling Microsoft about when installing did not go through to my clients computer as the OS was from the old broken system and sorted it out via phone, I forgot exactly did we activate it or did I get a code via phone but it also worked, forgive me as it was like 10 years ago :)
So if you buy a laptop or desktop with Windows 7 serial on it, and it not being any OEM as you said (The version of the Windows should be written on the label), it can be installed to any computer. I have done it :)

I've had 2 day old laptops that wouldn't take ** their own** keys.
Needed to downgrade to Win7, no real keys given, modern BIOS (grrr), and in the end… required preactivated discs (as Tony said above), or doctored ISOs.I'm all for messing, learning… but 1/10 times things go exactly to plan. SOOOO much Murphy's Law with IT.
Get an illegal version, I heard there's some cheap windows 7 keys available, I recall someone posting a link to a site that was selling them for $15 AUD and they upgrade to windows 10 for free. Have a look online for windows 7 keys
Everyone I know has some old STUFFED machine lying around. Even asking about it, "Hell, just have it". Take a nice photo of the sticker, and peel it off if you can. Even cut the hole plastic piece out, around it… if need be. License yours, legit, usually free.
I'm surrounded by people begging to "Just Pay The Money" $150++ "It's just easier".

well, if you ever, or have ever known someone to attend am public school they can log in through my portal and claim 1 copy of windows 8/10 and one copy of windows 7. both are the pro versions. you can also claim a full version of microsoft office proffesional
i have claimed at least 10 keys in total because i keep reinrolling myself as a "year 12" student. probably against the T&C's though
